Protecting children from harm<strong>Policy</strong> CH1To protect children from harm, the <strong>Licensing</strong> Authority will apply the following criteriaand take in to account the following considerations, where relevant, in determiningapplications and reviews:Criteria(i) Whether there are appropriate measures in place to protect children fromharm.Considerations(ii) Whether there are effective measures to check the age <strong>of</strong> those young peoplewho appear under 21 to ensure that alcohol is not sold to those under 18 andthose under 16 are accompanied in alcohol led premises (see Appendix 9).(iii) Whether the supply <strong>of</strong> alcohol for consumption on the premises is theexclusive or primary purpose <strong>of</strong> the services provided at the premises (revisedGuidance, paragraph 2.44).(iv) Whether accompanied children under 16 on the premises <strong>of</strong> which the primarypurpose is supply <strong>of</strong> alcohol for consumption on the premises are taking atable meal or are being entertained by a live performance.(v) The hour to which accompanied children under 16 are proposed to be on thepremises where the exclusive or primary purpose <strong>of</strong> the services provided atthe premises is the supply <strong>of</strong> alcohol for consumption on the premises.(vi) Whether due regard is paid to industry codes <strong>of</strong> good practice on the labelling4and display <strong>of</strong> alcoholic drinks. 1(vii) Whether there are adequate procedures for identifying unaccompanied or lostchildren and ensuring that they are kept safe and adequately supervised untilthey can be handed over to a responsible adult.(viii) The likelihood <strong>of</strong> children being attracted to the premises; eg by the nature <strong>of</strong>activities or facilities provided whether or not these are licensed.(ix) Whether there is evidence <strong>of</strong> heavy, binge or underage drinking on thepremises.(x) Whether the premises commonly provides entertainment or services <strong>of</strong> anadult or sexual nature (see Glossary).(xi) Whether there is a strong element <strong>of</strong> gambling on the premises (but not, forexample, the presence <strong>of</strong> a small number <strong>of</strong> cash prize gaming machines).(xii) Whether fi lms are to be shown and the measures to restrict children fromviewing age restricted fi lms classifi ed according to the recommendations <strong>of</strong>the British Board <strong>of</strong> Film Classifi cation or the council itself; revised Guidance(paragraph 13.53) refers.324 The Portman Group Code <strong>of</strong> Practice on the Naming, Packaging and Merchandising <strong>of</strong> Alcoholic Drinks and their Retail AlertBulletins on unsuitable packaging and marketing.
