2.1.4 Revised Guidance in paragraph 13.32 states “The absence of a special policy doesnot prevent any responsible authority or interested party making representationson a new application for the grant, or variation, of a licence on the grounds that thepremises will give rise to a negative cumulative impact on one or more of the licensingobjectives”. There will not be a policy presumption against grant of a premiseslicence outside the Stress Area on the grounds of cumulative impact. However theoverall effect of the grant of the licence will be considered in relation to evidence ofcumulative impact on the licensing objectives.2.1.5 When relevant representations are made, the Licensing Authority will apply the relevantparts of these policies in relation to applications including those for provisionalstatements, for variations to premises licences and to similar applications related toclub premises certifi cates for qualifying clubs for:• a new licence• an increase in the capacity of the premises• an extension in the hours of operation of the premises• a change to the way the premises operate in regard to the OperatingSchedule, which will have an impact on the promotion of the licensingobjectives• varying an existing condition attached to a premises licence, which will havean impact on the promotion of the licensing objectives2.1.6 As described in revised Guidance (paragraph 8.33-34), these policies will not apply toapplications to change the name or address of someone named in the licence or anapplication to vary the licence to specify a new individual as the designated premisessupervisor.20
2.2 Policies supporting each of thelicensing objectivesIntroduction/definitions2.2.1 These policies are intended to help applicants by setting out criteria andconsiderations that they should have in mind when drawing up an OperatingSchedule. Whereas the criteria, because they relate to the licensing objectives, willapply to all applications to some degree, the considerations listed may not necessarilyapply or apply equally to all applications. These considerations have been developedwith reference to the licensing objectives and in consultation with the responsibleauthorities. They therefore alert applicants to the matters that responsible authoritieswill be likely to consider when deciding whether to make representations on anapplication or whether to call for a review. They also draw the attention of applicantsto matters that are likely to be the subject of conditions designed to promote thelicensing objectives, that may be attached to the grant of a licence.Prevention of crime and disorderPolicy CD1To prevent crime and disorder, the Licensing Authority will apply the following criteriaand take into account the following considerations, where relevant, in determiningapplications and reviews:Criteria(i) Whether the premises make or will make a signifi cant contribution to levelsof crime and disorder, and whether the Operating Schedule is based on anadequate risk assessment, undertaken by the applicant, of the likelihood ofcrime and disorder occurring as a result of the grant of the application.Considerations(ii) In deciding this, regard will be had to: the levels of crime and disorder in andaround the venue; the proposals contained in the operating schedule; the levelof compliance to conditions on existing licences; and the extent to which theMetropolitan Police’s effective management checklist (see Appendix 7) hasbeen taken into account. This provides a comprehensive but not exhaustive listof considerations, not all of which will be applicable to all premises.21
