The request of the firm isregarding modification of export obligation in respect of advance licence No. 1524808dated 1.1.93. The committee has gone through the detailed report of the case submittedvide their letter No. 09/82/40/00513/AM93/Bonds/2210 dated 3.2.05. The firm wasissued the subject licence for the import of various raw materials required for the exportof Industrial Laminates. Based on the information submitted by the party and also reportof RLA, the committee after deliberations, decided to take the following actions in thiscase:i) The Jt.DGFT, Hyderabad shall ascertain the actual utilization of importedexempt materials under the advance licence in question in the productsactually exported from the declaration given in the shipping documents /Shipping bills of the exempted materials with quantities used for themanufacture of the product exported.ii)iii)iv)Thereafter, the quantity wise shortfall in fulfillment of export obligation maybe worked out as per input output norms at which the licence was issued.The default in fulfillment of export obligation (both quantity wise and valuewise) may be regularized as per procedures laid down in the HBP (Vol.1) i.epayment of customs duty + interest etcJt.DGFT, Hyderabad should ensure the proper accountability of importedinputs in the export products as per input output norms adopted in the licensewhile considering the request of the firm.Jt.DGFT, Hyderabad shall take further necessary action as per above decisions ofALC subject to compliance of all usual conditionsCase No. M- 51ALC No.02/06Dated:20.04.2005M/s.
