Annexure-32<strong>Election</strong> <strong>Commission</strong>'s direction No. 76/81, dated 18.09.1981Subject: Lodging <strong>of</strong> accounts <strong>of</strong> election expensesDIRECTIONUnder the powers vested in the <strong>Election</strong> <strong>Commission</strong> under Article 324 and in pursuance <strong>of</strong> rule 89 <strong>of</strong> theConduct <strong>of</strong> <strong>Election</strong>s Rules, 1971, and all other powers enabling it in that behalf and in order to ensurethat the work pertaining to the accounts <strong>of</strong> election expenses <strong>of</strong> the contesting candidates at a generalelection or a bye-election is complete expeditiously, the <strong>Commission</strong> directs that(i)(ii)(iii)(iv)(v)(vi)Each <strong>of</strong> the supporting vouchers lodged with account <strong>of</strong> election expenses shall bear thesignature in full <strong>of</strong> the contesting candidate or his election agent, if any:When a contesting candidate lodges his account <strong>of</strong> election expenses before the District<strong>Election</strong> Officer, the District <strong>Election</strong> Officer shall issue an acknowledgement immediately. Theacknowledgment shall be issued to the person concerned if account is presented in person orsent by post if received through post. The acknowledgement shall be as in the pr<strong>of</strong>orma forthe maintenance <strong>of</strong> account <strong>of</strong> election expenses.The District <strong>Election</strong> Officer shall send his report to the <strong>Election</strong> <strong>Commission</strong> as contemplatedin rule 89 <strong>of</strong> the Conduct <strong>of</strong> <strong>Election</strong> Rules, 1961 within ten days from the expiration <strong>of</strong> the 30days within which the account <strong>of</strong> election expenses in respect <strong>of</strong> a constituency is required tobe lodged;Under sub-rule (5) <strong>of</strong> rule 89 <strong>of</strong> the Conduct <strong>of</strong> <strong>Election</strong>s Rules, 1961 only one show-causenotice shall be sent by Registered A.D. Post to a candidate, who fails to lodge his account <strong>of</strong>election expenses within the time and in the manner required by law;When a notice is issued by Registered A.D. Post, unless the communication is receivedundelivered within a reasonable period, say a month, it shall be presumed that the notice hasbeen served on the candidate. On the expiry <strong>of</strong> one month after the date <strong>of</strong> issue <strong>of</strong> the notice,the case shall be disposed <strong>of</strong>.All correspondence with a candidate shall be sent to him at the address as furnished in thecontesting candidate list. A candidate shall intimate in writing the District <strong>Election</strong> Officerconcerned about the change in his address, if any for future correspondence. The Districtelection Officer shall intimate to the <strong>Election</strong> <strong>Commission</strong> forthwith the change.139
