constituencies or comes back to his own constituency from other constituencies as a starcampaigner, the expenditure on his travel from his constituency to other constituencies andback would fall within the exempted category. Once he reaches his constituency and travelswithin his own constituency, expenditure on such travel would be liable to be accounted forby him in his election expenditure.10.5. The lump sum amount given either in cash or in kind by the political party shall be reportedby the party as well as the candidate in his day to day accounts and the abstract statement <strong>of</strong>election expenses, required to be filed within 30 days <strong>of</strong> declaration <strong>of</strong> result. .10.6. The expenditure in kind, like party posters or banners or advertisements, without the nameor photograph <strong>of</strong> the candidate is to be shown as party expenditure by the political party.Even the party expenditure during the period after announcement <strong>of</strong> election by ECI andbefore notification <strong>of</strong> election, has to be shown by the political party as its electionexpenditure. The political party shall forward its election expenditure in prescribed formatalong with scanned s<strong>of</strong>t copy to the <strong>Election</strong> <strong>Commission</strong> within 75 days <strong>of</strong> Assembly pollor 90 days <strong>of</strong> Lok Sabha poll.10.7 The expenses after the poll and before the date <strong>of</strong> counting, which can be said to be inconnection with the election shall alone be accounted for by the candidates as per section 77<strong>of</strong> the Representation <strong>of</strong> the People Act, 1951. After the poll, the expenses on travel <strong>of</strong> a StarCampaigner or a candidate (not connected with his election) shall not be added to theexpenses <strong>of</strong> any candidate. If the Star Campaigner/Candidate visits his constituency, wherehe has contested the election, the travel expenses within the constituency for overseeing thecounting arrangements before, or on the date <strong>of</strong> counting shall be added to his account. Thetravel expenses outside the constituency will not be added to his account. If the politicalparty is bearing travel expenses <strong>of</strong> a Star Campaigner outside his constituency, the saidexpense shall be shown by the political party in the accounts submitted to the <strong>Commission</strong>within 75 days <strong>of</strong> the completion <strong>of</strong> election.(<strong>Commission</strong>’s Instruction No.76/Instructions/2012/EEPS dated 9 th February, 2012 Annexure 59)11.1. Scrutiny <strong>of</strong> the Statement <strong>of</strong> Accounts and the DEO’s Report to the <strong>Commission</strong>.Under Rule 89 <strong>of</strong> the Conduct <strong>of</strong> <strong>Election</strong>s rules, 1961 the District <strong>Election</strong> Officer has toreport to the <strong>Commission</strong> whether the candidate has lodged his account <strong>of</strong> electionsexpenses, and whether in his opinion such account has been lodged within time and in themanner required by the Act and the Rules. The DEO shall send the candidate wise scrutinyreport and summary report <strong>of</strong> all the candidates as per the format enclosed as Annexure 21to CEO <strong>of</strong> the State within 45 days <strong>of</strong> declaration <strong>of</strong> results. Where the DEO is <strong>of</strong> theopinion that the account <strong>of</strong> the election expenses <strong>of</strong> any candidate has not been lodged in themanner required by the Act and these rules and he has the reason to believe that theexpenditure statement submitted by the candidate is not a true account <strong>of</strong> his expenditure,then the DEO should record the reason and report to the <strong>Commission</strong> that the Accountstatement is not in the manner prescribed. He shall with every such report forward to the<strong>Election</strong> <strong>Commission</strong> the comments <strong>of</strong> <strong>Expenditure</strong> Observer, original account <strong>of</strong> election42
