The specific Rulesand Procedures for reporting charges ofProhibited Discrimination and for pursuingavailable remedies are incorporated inthe Board Rules in Chapter 15, Board Rules1501-1522.Copies of the policy and procedures maybe obtained from the LACCD Office ofDiversity Programs and campusesWebsites, the Compliance Officer at eachlocation, by calling the Director of DiversityPrograms at 213/ 891-2315.The PolicyIt is the policy of the <strong>Los</strong> <strong>Angeles</strong>Community <strong>College</strong> District to provide aneducational, employment and business environmentfree from Prohibited Discrimination.Employees, students, or other persons actingon behalf of the District who engage inProhibited Discrimination as defined in thispolicy or by state or federal law shall be subjectto discipline, up to and including discharge,expulsion or termination of contract.Academic FreedomThe Board of Trustees reaffirms its commitmentto academic freedom, but recognizesthat academic freedom does not allowProhibited Discrimination. The discussion ofideas, taboos, behavior or language which isan intrinsic part of the course content shall inno event constitute Prohibited Discrimination,though such ideas may cause some studentsdiscomfort. It is recognized that academicfreedom insures the faculty’s right toteach and the student’s right to learn.Definition of ProhibitedDiscriminationProhibited Discrimination is defined as discriminationor harassment in violation ofstate or federal law on the basis of actualor perceived ethnic group identification,race, color, national origin, ancestry, religion,creed, sex (including gender-based sexualharassment), pregnancy, marital status, cancer-relatedmedical condition of an employee,sexual orientation, age, physical or mentaldisability, or veteran status.Definition of Sexual HarassmentSexual harassment is unwelcome sexual advances,requests for sexual favors, and otherverbal, visual or physical conduct of a sexualnature, made by someone from or in theworkplace or in the educational setting.RetaliationRetaliation against anyone who makes a complaint,refers a matter for investigation or complaint,participates in investigation of a complaint,represents or serves as an advocate foran alleged victim or alleged offender, or otherwisefurthers the principles of this policy.False AllegationsAnyone who files a complaint in which he/she knowingly makes false allegations of factshall also have violated this policy and shallbe subject to disciplinary action.ConfidentialityAll persons involved in investigation of complaintsshall have a duty to maintain the confidentialityof the matters discussed, exceptas may be required or permitted by law,which include the rules and regulations ofthe District. A complete record of each complaintand investigation shall be kept by theDirector of Diversity Programs. The WrittenDecision or any Settlement Agreement regardingthe results of the investigation shallbe placed in the personnel file of each employeeinvolved as an alleged offender, allegedvictim or complainant.Complaint ProcedureGeneral ProvisionsThe Director of Diversity Programs is responsiblefor receiving complaints and coordinatinginvestigations from within theDistrict, from other governmental agencies,and from outside sources. Each<strong>College</strong> President shall designate a CO forthe campus, not a faculty member, and theChancellor shall designate the CO for theDistrict Office. Each <strong>College</strong> President, inconsultation with the ASO President, shalldesignate an employee who shall serve asAdvocate for Students (AFS). All Supervisorsshall be responsible for maintaining a work134


pregnancy, marital status, sexual orientation,age, handicap or veteran status. Employees, students, orother persons acting on behalf of the Districtwho engage in sexual harassment as definedin the policy or by state or federal law shallbe subject to discipline, up to and includingdischarge, expulsion or termination of contract.The specific rules and procedures forreporting charges of sexual harassment andfor pursuing available remedies are incorporatedin the Board Rules in Chapter 15.The <strong>Los</strong> <strong>Angeles</strong> Community <strong>College</strong> Districthas a policy which provides formal and informalprocedures for resolving complaints.Copies of the policy and procedures maybe obtained from the Sexual HarassmentCompliance Officer in E1-136, the Advocatefor Students at the South Gate EducationalCenter, or by calling the Office of the ViceChancellor of Instructional and StudentSupport Services at 213-891-2279, or theOffice of Diversity Program at 213-891-2315.Any member of the <strong>College</strong> Community -student, faculty, or staff - who believes he orshe has experienced conduct that may constitutesexual harassment has the right toseek the help of the <strong>College</strong>. Thedesignated smoking areas are limited tosmoking outside the buildings. Individualswho smoke should make provisions to do soon their breaks in the designated areas.Drug-Free Schools and Campus<strong>East</strong> <strong>Los</strong> <strong>Angeles</strong> <strong>College</strong> adheres to,supports, and is in full compliance withrequirements that maintain our college as adrug-free institution of higher education.Standards of ConductOn April 20, 1989, the District Board ofTrustees adopted Rule 9803.19, whichprohibits:Alcohol and Drugs. Any possession of controlledsubstances which would constitutea violation of Health and Safety Code section11350 or Business and ProfessionsCode section 4230, any use of controlledsubstances, the possession of which areprohibited by the same or any possessionor use of alcoholic beverages while on anyproperty owned or used by the District orcolleges of the District. “Controlled substances,”as used in this section, include,but are not limited to the following drugs andnarcotics:a. opiate, opium and opium derivativesb. mescalinec. hallucinogenic substancesd. peyotee. marijuanaf. stimulants and depressantsg. cocaineThe Board’s policy on the drug-freeWorkplace, adopted on March 22, 1989 restatesthese prohibitions.On September 5, 1990, the Board ofTrustees adopted the following standards ofconduct:Students and employees are prohibited fromunlawfully possessing, using or distributingillicit drugs and alcohol on district premises,in district vehicles, or as part of any activity ofthe <strong>Los</strong> <strong>Angeles</strong> Community <strong>College</strong> District.9803.25-Conduct that may be considereddisorderly includes: lewd or indecent attireor indecent attire or behavior that disruptsclasses or college activities; breach of thepeace of the college; aiding, or inciting anotherperson to breach the peace of collegepremises or functions.elac FALL 2012136
