THE TORTIOUS CONDUCTWhitney was convinced that Strudwick was involved with Weiss’s legal battle <strong>for</strong>control over MDMSA and has since launched a personal campaign against Strudwick andWeiss to cause injury to <strong>the</strong>m and anyone associated with <strong>the</strong>m. On June 15, 2006 Whitneysent an email to Ramirez, Strudwick’s business partner, threatening litigation, criminalcharges, and public humiliation. Specifically, <strong>the</strong> email warned that he and Strudwick should“[g]et ready <strong>for</strong> some criminal and o<strong>the</strong>r charges,” which would be publicized “big time inCosta Rica and <strong>the</strong> U.S.” The email fur<strong>the</strong>r warned Ramirez that his “partner [Strudwick] isin <strong>for</strong> <strong>the</strong> shock of his life.” In a subsequent email on that same day, Whitney warned that“[t]he process has started and you and your family are going to be affected, as is Barry[Strudwick].”On December 22, 2006 Rothstein, counsel <strong>for</strong> WIN and Whitney, sent an email toStrudwick stating that he had filed a lawsuit against Strudwick, and that threatened “fur<strong>the</strong>rlegal action that is certain to be protracted, expensive and embarrassing” if Strudwick did notcease “all actions pertaining to <strong>the</strong> Monterey project.” The statement that a lawsuit had beenfiled against Strudwick was false as <strong>the</strong> actual lawsuit was not filed until over one monthlater on January 29, 2007. The email, which is attached to <strong>the</strong> complaint, states in part:As you should be aware via <strong>the</strong> lawsuit filed in New Yorkagainst you, Susan Weiss, and your fellow co-conspirators, thisfirm is senior litigation counsel to <strong>the</strong> Whitney Group ofcompanies.* * *. . . . As you should now be aware, <strong>the</strong> lawsuit against you andyour co-conspirators now includes multiple counts implicatingall of you in a conspiracy of unprecedented magnitude.Moreover, we will not only continue to add to and amend <strong>the</strong>6
