<strong>NIKE</strong> <strong>THE</strong> <strong>CHANCE</strong> <strong>CONTEST</strong> <strong>–</strong> <strong>OFFICIAL</strong> <strong>RULES</strong><br />

These are the official rules (“Official Rules”) of <strong>NIKE</strong>’s The Chance contest and may be<br />

amended or updated by <strong>NIKE</strong> at any time. The current version of the Official Rules shall<br />

be made available on <strong>NIKE</strong>’s website at www.nikefootball.com.<br />

1. No Purchase Required to Enter or Win the Contest (“the Contest”)<br />

No purchase is required to enter the Contest. By entering this Contest, individual entrants<br />

(“Entrants”) accept and agree to be bound by these Official Rules which may be varied by<br />

<strong>NIKE</strong> from time to time. The current version of the Official Rules shall be made available<br />

on <strong>NIKE</strong>’s website at www.nikefootball.com.<br />

2. Important Notice for Amateur Athletes<br />

Entrants are responsible for ensuring that their use of or participation in the activities of<br />

this Contest does not affect their eligibility as an amateur athlete. Please check with your<br />

amateur athletic association for the rules that apply to you. <strong>NIKE</strong> IS NOT RESPONSIBLE<br />

OR LIABLE FOR YOUR PARTICIPATION IN THIS <strong>CONTEST</strong> RESULTING IN YOUR<br />

INELIGIBILITY AS AN AMATEUR ATHLETE.<br />

3. Who is eligible?<br />

The Contest is open only to residents of the countries at Annex 1 to these Official Rules<br />

who are over 16 years of age at the time of entry. Entrants aged between 16 and 18<br />

must have consent from their parent or legal guardian to enter the Contest. Entrants<br />

attending the Global Final and Winners of the Grand Prize must have a valid passport and<br />

visa for all travel. Employees of <strong>NIKE</strong> USA, Inc., its parent company, <strong>NIKE</strong>, Inc., their<br />

subsidiaries and affiliates, or of other companies associated with the promotion of the<br />

Contest, as well as the immediate family (spouse, parents, siblings, and children) and<br />

household members of each such employee are not eligible.<br />

4. Who is sponsoring the Contest?<br />

The Contest is sponsored by Nike European Operations Netherlands B.V. whose registered<br />

office is at Colosseum 1, 1213, NL Hilversum, The Netherlands (“<strong>NIKE</strong>”). <strong>NIKE</strong> reserves<br />

the right to modify or cancel this promotion at any time and, in the event of cancellation,<br />

substitute another in its place. This information will be published on <strong>NIKE</strong>’s website at<br />

www.nikefootball.com. This Contest is in no way sponsored, endorsed or administered by,<br />

or associated with, Facebook. You understand that you are providing your information to<br />

<strong>NIKE</strong> and not to Facebook. The information you provide to Nike will only be used for<br />

purposes of the Contest.<br />

5. How do I enter?<br />

The Contest will begin on 05 th March 2012 and will continue until 27 th June 2012 (the<br />

“Entry Period”). During the Entry Period there will be 4 stages:<br />

a. STAGE 1: SCOUTING<br />

Entrants can enter in three ways:<br />

(i) Entrants can set up a Facebook fan page with details of their football<br />

achievements and encourage people to become a fan of their page.<br />

Entrants should then register their Facebook fan page at<br />

nikefootball.com and <strong>NIKE</strong> staff will decide which Entrants will go<br />

through to Stage 2 based on the popularity of the Facebook fan page<br />

and the skill level of the Entrant’s football achievements, as<br />

demonstrated on the Facebook fan page. <strong>NIKE</strong> staff may contact the<br />

Entrant to verify the information posted on the fan page. Entrants<br />

must make sure that their Facebook fan page only contains images of<br />

themselves. Entrants’ Facebook fan page must not contain any<br />

images, videos, music and/or other media that that are copyrighted,<br />

trademarked, protected by trade secret or otherwise subject to third<br />

party proprietary rights, including privacy and publicity rights, unless<br />

Entrant is the owner of such rights or has permission from their<br />

rightful owner to post the material. Entrants must comply at all<br />

times with the rules of Facebook.<br />

(ii) Entrants can be identified by <strong>NIKE</strong> or associated football scouts or<br />

coaches at a <strong>NIKE</strong> or other football scouting event between 05 th<br />

March 2012 and the 27 th June 2012 as having the football skill level<br />

to qualify them to go through to Stage 2.<br />

(iii) <strong>NIKE</strong> may personally request an Entrant to go through to Stage 2 as<br />

they are known to <strong>NIKE</strong> as a high quality footballer who does not<br />

currently have a professional contract and who would be eligible to<br />

participate in this Contest.<br />

b. STAGE 2: REGIONAL FINALS<br />

Those selected in Stage 1 (“Stage 1 Finalists”) will be invited to the Regional<br />

Finals which will consist of football trials in the <strong>UK</strong> between 28 th June 2012 and<br />

the 01 st July 2012 where they will be tested by <strong>NIKE</strong> or associated football scouts<br />

or coaches for their football ability. Tests are likely to include fitness, skill and<br />

game play. <strong>NIKE</strong> or associated football scouts or coaches will, at their sole<br />

discretion, select the Stage 1 Finalists with the highest level of footballing ability<br />

to go through to the next Stage (“Stage 2 Finalists”).<br />

<strong>NIKE</strong> will not pay for any transportation or any other costs in relation to the Stage<br />

1 Finalists attendance at the Regional Finals <strong>–</strong> all such costs must be paid for by<br />

the Entrant. Notwithstanding Nike may choose to provide hospitality to Entrants at<br />

the Regional finals but is under no obligation to do so.<br />

c. STAGE 3: GLOBAL FINAL<br />

The Stage 2 Finalists will be sent to Barcelona (Spain) for a final trial against other<br />

Stage 2 Finalists from all over the world. The Global Final will be run in a similar<br />

way as the Regional Finals and players will be tested for their football ability with<br />

tests including fitness, skill and game play. <strong>NIKE</strong> or associated football scouts or<br />

coaches will, at their sole discretion, select 16 Stage 2 Finalists from around the<br />

world with the highest level of footballing ability to go through to the next Stage,<br />

which is the Grand Prize, (the “Winners” and each “a “Winner”).<br />

Nike will pay for transportation costs to transport the Entrant from their country of<br />

residence to the Global Final in Barcelona. Nike will also pay for reasonable<br />

accommodation, transfers and hospitality costs for Entrants while they are<br />

attending the Global Final.<br />

STAGE 4: <strong>THE</strong> GRAND PRIZE<br />

The 16 Winners (who could come from any country and may or may not include a<br />

Entrant from each entering country) will be given the chance to tour with The<br />

<strong>NIKE</strong> Academy as an “elite” football team. This international tour will run at a<br />

time to be decided by Nike in its sole direction between September 2012 and<br />

February 2013 and will connect with <strong>NIKE</strong> football clubs and coaches around the<br />

world offering the 16 Winners a platform to showcase their football talent.<br />

6. How will winners be selected?<br />

Selection will be made as follows:<br />

a. Selection for the <strong>UK</strong> Final between 05 th March 2012 and 27 th June 2012<br />

Selection by <strong>NIKE</strong> based on any one of the following criteria:<br />

(i) football performance at a <strong>NIKE</strong> event or an officially organized event<br />

attended by <strong>NIKE</strong> or associated football scouts or coaches; and/or<br />

(ii) demonstration of ability through description on social media fan<br />

page; and/or amount of support to Facebook fan page.<br />

b. Selection for the Global Final <strong>–</strong>28 th June 2012 and 1 st July 2012<br />

Selection by <strong>NIKE</strong> or associated football scouts or coaches will be based on<br />

observation of football performance. <strong>NIKE</strong> or associated football scouts will, in<br />

their sole discretion, draw upon information from fitness tests such as SPARQ,<br />

skill tests (from Elite Training Live), GPS match data and from 11-a-side game<br />

assessment.<br />

c. Selection for the Grand Prize to take place between August 17 th and August 27 th<br />

2012<br />

Winners will be selected by <strong>NIKE</strong> or associated football scouts or coaches based<br />

on their ability and potential to play football at a professional level. The key<br />

criteria will be fitness, technique, skill and demonstration of having the mental<br />

strength to compete at the highest level. Each player will be given an opportunity<br />

to perform in a full 11v11 game in front of the judges as well as partaking in<br />

fitness and skill tests.<br />

Decisions of <strong>NIKE</strong> are final and binding in all respects, and by participating, Entrant<br />

agrees to be bound by these Official Rules and <strong>NIKE</strong>’s decisions. Notification of Finalists<br />

and Winners will be published on www.nikefootball.com.<br />

7. What can I win?<br />

Winners will receive an all-expenses paid tour to a number of professional football clubs<br />

located around the world (“the Tour”) to include:<br />

a. Round-trip coach-class airfare to Portland Oregon from [airport in country] nearest<br />

Winner’s home;<br />

b. Hotel accommodations or University halls of residence, for the duration of the Tour<br />

(one standard room, double occupancy) at a <strong>NIKE</strong>-designated hotel or other<br />

premises;<br />

c. Meals;<br />

d. Ground transportation (travel from airport to hotel and to any football and Tour<br />

facilities); and<br />

e. Access to football facilities (training and playing on professional quality football<br />

pitches with access to professional facilities such as coaching and physiotherapy).<br />

Approximate retail value (“ARV”): up to £15,300 each<br />

8. Trip Restrictions<br />

Departure dates and times are subject to availability and at the sole discretion of <strong>NIKE</strong>.<br />

Certain restrictions and blackout dates may apply. If Finalist/Winner is unavailable to<br />

travel on required dates, the prize will be forfeited and an alternate winner may be<br />

selected. Actual value may vary depending on Finalist/Winner’s point of travel origin,<br />

airfare and hotel fluctuations. Any difference between stated ARV and actual value will<br />

not be awarded. Airport, airline, tickets and/or hotel accommodations are to be selected<br />

by <strong>NIKE</strong> in its sole discretion.<br />

Any Finalist/Winner travelling to the Regional Final, Grand Final and on the Tour shall be<br />

responsible for all applicable visa, permit or other travel authorisations. <strong>NIKE</strong> may assist<br />

with any such visa applications and/or permissions but shall have no responsibility or<br />

liability to any Finalist/Winner who fails to secure a visa or applicable travel permissions.<br />

All cost and expenses in relation to obtaining such visa, permit or other travel<br />

authorisations shall be borne by such Finalist/Winner. Finalists/Winners will not be<br />

afforded any compensation by <strong>NIKE</strong> if they are unable to secure a visa or applicable travel<br />

permissions.<br />

Insurance, all expenses and incidentals not mentioned above are the responsibility of the<br />

Entrant. Any Finalist/Winner shall be obtain their own travel insurance and shall provide a<br />

copy of such travel insurance to <strong>NIKE</strong> on request. All travel must be completed on the<br />

dates specified by <strong>NIKE</strong>, or the prize will be forfeited. Entrants participation in any or all<br />

activities associated with this Contest is voluntary. In the event that Entrants elect not to<br />

participate in any or all designated activities forming part of the Contest, Entrants will be<br />

afforded no additional compensation in exchange therefore.<br />

Any prize details not specified above will be determined by <strong>NIKE</strong> in its sole discretion.<br />

Prizes are not transferable and must be accepted as awarded. No cash or other<br />

substitution may be made, except by <strong>NIKE</strong>, who reserves the right to substitute a prize<br />

with another prize of equal or greater value if the prize is not available for any reason as<br />

determined by <strong>NIKE</strong> in its sole discretion.<br />

Minors must have a consent form signed by their parent or legal guardian granting their<br />

consent for the minor to participate in each stage of the Contest, to undergo physical or<br />

other tests, for the minor’s personal data to be processed and to sign a Tour contract if the<br />

minor is a potential winner. In respect of the Global Final, the minors parent or legal<br />

guardian must sign a consent form granting a suitable <strong>NIKE</strong> chaperon the authority to<br />

accompany the minor to the Global Final and (if applicable) on the Tour and for such<br />

chaperone to approve any emergency medical needs of the minor that may occur during<br />

and/or as a consequence of the Contest. <strong>NIKE</strong> will provide at its sole discretion and<br />

expense provide 1 chaperones per 4 Winners.<br />

Minors will not be permitted to partake in the tour without a signed consent form.<br />

The Winner is responsible for taxes and any and all other costs and expenses not listed.<br />

9. What may a potential winner be required to do?<br />

Except where prohibited, a potential winner may be required to complete and return all<br />

required documentation, including an executed applicable Consent form for each stage of<br />

the Contest.<br />

Before the start of the Tour, a Winner will also be required to: (i) pass a physical, date to<br />

be decided by Winner’s respective Nike country; (ii) remain injury free; and (iii) sign a<br />

Tour contract. If the Winner is not able to complete the above requirements, they will be<br />

disqualified without any right to compensation.<br />

If a potential Winner declines to accept the prize, has violated any of these Official Rules,<br />

or fails to sign and return the required documents within the required time period, an<br />

alternate entrant will not be selected.<br />

10. What other terms should I be aware of?<br />

By participating in the Contest, Entrants agree to be bound by these Official Rules and the<br />

determinations of <strong>NIKE</strong>, which shall be final. Any violation of the Official Rules may result<br />

in disqualification. <strong>NIKE</strong> has no obligation to notify violators of their disqualification.<br />

Unless prohibited by law Entrants, or if Entrant is aged under 18 then Entrant’s parent or<br />

legal guardian, agrees to allow use of Entrants name, voice, place of residence,<br />

photograph, and/or likeness for advertising and/or trade and/or any other purpose in any<br />

media or format now or hereafter known without further compensation, permission or<br />

notification.<br />

The Contest is subject to all country and local laws and regulations and is void where<br />

prohibited by law. In the event that the operation, security, or administration of the<br />

Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or<br />

other technical problem, <strong>NIKE</strong> may, in its sole discretion, either: (a) suspend the Contest<br />

to address the impairment and then resume the Contest in a manner that best conforms to<br />

the spirit of these Official Rules; or (b) award the prize at random from among the eligible<br />

entries received up to the time of the impairment. <strong>NIKE</strong> reserves the right in its sole<br />

discretion to disqualify any individual it finds to be tampering with the entry process or<br />

the operation of the Contest or to be acting in violation of these Official Rules or in an<br />

unsportsmanlike or disruptive manner. Any attempt by any person to undermine the<br />

legitimate operation of the Contest may be a violation of criminal and civil law, and,<br />

should such an attempt be made, <strong>NIKE</strong> reserves the right to seek damages from any such<br />

person to the fullest extent permitted by law. Failure by <strong>NIKE</strong> to enforce any term of<br />

these Official Rules shall not constitute a waiver of that provision.<br />

To the extent permitted by law by participating in the Contest, Entrants agree to release<br />

and hold harmless Facebook, <strong>NIKE</strong>, its parent and related companies, and their respective<br />

officers, directors, employees, and agents (the “Released Parties”) from and against any<br />

claim or cause of action arising out of participation in the Contest or receipt or use of any<br />

prize, including, but not limited to: (a) unauthorized human intervention in the Contest;<br />

(b) technical errors related to computers, servers, providers, or telephone or network lines;<br />

(c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors<br />

in the administration of the Contest or the processing of entries; or (f) injury or damage to<br />

persons or property which may be caused, directly or indirectly, in whole or in part, from<br />

entrant’s participation in the Contest or receipt or use of any prize. To the extent<br />

permitted by law and with the exception of liability for gross negligence or willful<br />

misconduct of the Released Parties, Entrants further agree that in any cause of action (i)<br />

the Released Parties’ liability will be limited to the cost of participating in the Contest, and<br />

in no event shall the Released Parties be liable for legal fees and (ii) Entrant waives the<br />

right to claim any damages whatsoever that may arise in connection with these Official<br />

Rules or Entrant's participation in the Contest.<br />

In order to participate in the Contest, Entrants will be required to supply certain<br />

information about themselves on the Contest entry page. <strong>NIKE</strong> has specified which<br />

information is mandatory in order to participate in the Contest. This information will be<br />

used by <strong>NIKE</strong> for the purposes of administering the Contest. All personal information<br />

provided by the Entrant will be subject to the <strong>NIKE</strong> Privacy and Cookie Policy which can<br />

be found at http://nike-eu.custhelp.com/app/answers/detail/a_id/6.<br />

11. How will disputes be handled?<br />

These Official Rules and any disputes in connection thereto will be governed by and<br />

construed in accordance with Dutch law. The parties hereby submit to the exclusive<br />

jurisdiction of the competent courts in Amsterdam with respect to any disputes arising out<br />

of or in connection with these Official Rules.<br />

12. How can I find out who won?<br />

The names of the winners will be published on www.nikefootball.com.<br />
