PurposeDECREES:Chapter IGeneral provisi<strong>on</strong>sThis <str<strong>on</strong>g>Decree</str<strong>on</strong>g> prescribes the plant quarantine activities related to import, export, temporaryimport, temporary export, transit, domestic quarantine and treatments of regulated articles.Article 2. Scope of applicati<strong>on</strong>This <str<strong>on</strong>g>Decree</str<strong>on</strong>g> shall apply to any <str<strong>on</strong>g>Viet</str<strong>on</strong>g>namese and foreign organizati<strong>on</strong>s and/or individuals thatare involved in plant quarantine activities carried out in the territory of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>, exceptotherwise stipulated in internati<strong>on</strong>al treaties to which <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> is a signatory or a c<strong>on</strong>tractingparty.Article 3. Definiti<strong>on</strong>sIn this <str<strong>on</strong>g>Decree</str<strong>on</strong>g>, the following terms shall have the meanings hereunder assigned to them:1. Pest: any species, strain or biotype of plant, animal or pathogenic agent injurious toplants or plant products, including: insects, fungi, bacteria, virus, phytoplasma, weeds, mouse andother organisms harmful to plant resources2. <strong>Quarantine</strong> pest: a pest of potential ec<strong>on</strong>omic importance to the area endangered therebyand not yet present there, or present but not widely distributed and being officially c<strong>on</strong>trolled.3. Regulated n<strong>on</strong>-quarantine pest: a n<strong>on</strong>-quarantine pest whose presence in plants forplanting affects the intended use of those plants with an ec<strong>on</strong>omically unacceptable impact andwhich is therefore regulated within the territory of the importing country.


24. Regulated pest: a quarantine pest or a regulated n<strong>on</strong>-quarantine pest5. New pest: any pest that has not been identified <strong>on</strong> the basis of scientific evidence and notfound previously in the country.6. Beneficial organism: any virus, bacterium, nematode, fungus, insect, animal or any otherorganism which helps reduce damage to plants and plant products due to pests.7. Regulated article: any plant, plant product, storage place, packaging, c<strong>on</strong>veyance,c<strong>on</strong>tainer, soil and any other organism, object or material capable of harboring regulated pests.8. Pest infestati<strong>on</strong> status: level and characteristics of pest present in a commodity.9. Inspecti<strong>on</strong> of articles: involves survey, observati<strong>on</strong>, m<strong>on</strong>itoring, sampling, testing,identificati<strong>on</strong> and research to determine infestati<strong>on</strong> status.10. Disinfestati<strong>on</strong>: official procedure for the absolute killing of pests <strong>on</strong> articles.11. Fumigati<strong>on</strong>: treatment with a chemical agent that reaches the commodity wholly orprimarily in a gaseous state.12. . Epidemic focus: is a place where exist <strong>on</strong>e or several kinds of harmful organisms <strong>on</strong>the promulgated lists of quarantine pests or regulated n<strong>on</strong>-quarantin pests;13. Outbreak area: an area with a quarantine pest defined by a competent quarantineauthority.14. Lot of articles: a quantity of articles, identifiable by its homogeneity of compositi<strong>on</strong> andpotential of infestati<strong>on</strong>.15. Place of quarantine inspecti<strong>on</strong>: a premise where inspecti<strong>on</strong> is c<strong>on</strong>ducted before movingthe articles.16. Pest risk analysis: the process of evaluating biological or other scientific and ec<strong>on</strong>omicevidence to determine whether a pest should be regulated and the strength of any phytosanitarymeasures to be taken against it.17. Pest free area: An area in which a specific pest does not occur as dem<strong>on</strong>strated byscientific evidence and in which, where appropriate, this c<strong>on</strong>diti<strong>on</strong> is being officiallymaintained.18. Equivalence: the use of different phytosanitary measures while achieving similareffects.19. Surveillance: an official process which collects and records data <strong>on</strong> pest occurrence orabsence by survey, m<strong>on</strong>itoring or other procedures.


20. Harm<strong>on</strong>izati<strong>on</strong> of phytosanitary measures: the establishment, recogniti<strong>on</strong> andapplicati<strong>on</strong> by different countries of phytosanitary measures based <strong>on</strong> comm<strong>on</strong> standards.21. <strong>Plant</strong>: living plants and parts thereof, including seeds and germplasm.22.<strong>Plant</strong> products: unmanufactured material of plant origin and those manufacturedproducts that, by their nature or that of their processing, may create a risk for the introducti<strong>on</strong> andspread of pests.23. Newly imported seed: any seed which has not appeared as in the list of varietiespermitted for producti<strong>on</strong> and sale24. Phytosanitary measure: Any legislati<strong>on</strong>, regulati<strong>on</strong> or official procedure having thepurpose to prevent the introducti<strong>on</strong> and/or spread of quarantine pests, or to limit the ec<strong>on</strong>omicimpact of regulated n<strong>on</strong>-quarantine pests.25. Place of origin: a place where the plants were grown or initate the infested status26. <strong>Quarantine</strong> facility: official stati<strong>on</strong> for growing plants or holding plant products inquarantine which is isolated from the envir<strong>on</strong>ment.27. Import permit: official document authorizing importati<strong>on</strong> of a commodity in accordancewith specified phytosanitary requirements.Article 4. Resp<strong>on</strong>sibilities of article owner1. M<strong>on</strong>itoring and c<strong>on</strong>trol pests, treatment of infested articles, n<strong>on</strong>-compliance articles forimport or export, and movement of articles from a outbreak area in accordance withphytosanitary regulati<strong>on</strong>s.In cases where infested articles of various owners must be treated simultaneously while thearticle owners cannot reach agreement <strong>on</strong> the treatment thereof, the plant quarantine authorityshall make decisi<strong>on</strong>s with which the articles owners must comply.2. Regularly m<strong>on</strong>itoring the pest status harmful to plant resources under ownership ordirectly handleAt places where import articles are often gathered, transited or brought from outbreak areas,the above-menti<strong>on</strong>ed m<strong>on</strong>itoring must be effected up<strong>on</strong> requests and under the guidance of thecompetent plant protecti<strong>on</strong> and quarantine State bodies;3. Up<strong>on</strong> detecting or doubting the existence of regulated pests <strong>on</strong> the promulgated list orstrange harmful organisms, the articles owners or the detectors shall have to apply necessarymeasures to eliminate and stop their spread, and at the same time to immediately report to thenearest competent plant protecti<strong>on</strong> and quarantine State bodies or local administrati<strong>on</strong> there<strong>on</strong>;4. To apply article-treating measures decided by the competent plant protecti<strong>on</strong> andquarantine State bodies;3


d. For exported articles being packed together with other exports (except hand luggage andaccompanied luggage), the owner, when submitting dossiers for customs clearance, must havephytosanitary certificate issued by <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> plant quarantine authority if it is required by theimporting country.2. The plant quarantine authorities shall inspect, verify and make results available within 24hours after inspecti<strong>on</strong> of the c<strong>on</strong>signment. Where it is l<strong>on</strong>ger than 24 hours, the articles ownersshall be notified.3. The inspecti<strong>on</strong> and documentati<strong>on</strong> of regulated articles shall be undertaken uniformlynati<strong>on</strong>wide in compliance with legislative provisi<strong>on</strong>s of the Ministry of Agriculture and RuralDevelopment.Article 9. Prohibiti<strong>on</strong>s1. Bringing into <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> any regulated pests under the lists referred to in paragraph 1.a ofArticle 7 of this <str<strong>on</strong>g>Decree</str<strong>on</strong>g>, or any living new pests at any development stage.2. Bringing any living regulated pests under the lists prescribed in paragraph 1.a of Article 7of this <str<strong>on</strong>g>Decree</str<strong>on</strong>g> into n<strong>on</strong>-infested areas.3. Bringing any subjected to PRA prescribed in paragraph 1.b of Article 7 of this <str<strong>on</strong>g>Decree</str<strong>on</strong>g>into n<strong>on</strong>-infested areas.4. Bringing plants with soil into <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> in any form.6Chapter IIImport <strong>Plant</strong> <strong>Quarantine</strong>Article 10. Import plant quarantine requirementsThe imported c<strong>on</strong>signment shall meet the following requirements:1. A phytosanitary certificate issued by the competent authority of the exporting country;2. Free from regulated pests in the lists referred to in paragraph 1.a of Article 7 of this<str<strong>on</strong>g>Decree</str<strong>on</strong>g> and new pests; if infested, complete treatments must be made.3. Import plant quarantine permit issued by the <strong>Plant</strong> Protecti<strong>on</strong> Department is required forarticles subject to PRA before importing into <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>.4. Imported wood packaging materials must undergo appropriate phytosanitary treatments.


7Article 11. Procedure for issuing import plant quarantine permit1. Organizati<strong>on</strong>s and/or individuals file the request for import quarantine permit accordingto specified form.2. Providing sufficient informati<strong>on</strong> relating to imported articles to The <strong>Plant</strong> Protecti<strong>on</strong>Department in accordance with Paragraph 6 of Article 4 of this <str<strong>on</strong>g>Decree</str<strong>on</strong>g> and regulati<strong>on</strong>s of theMinistry of Agriculture and Rural Development.3. The <strong>Plant</strong> Protecti<strong>on</strong> Department shall c<strong>on</strong>duct PRA for imported articles.4. Depending <strong>on</strong> PRA results, the <strong>Plant</strong> Protecti<strong>on</strong> Department may or may not grant importplant quarantine permit to the organizati<strong>on</strong>s and/or individuals c<strong>on</strong>cerned.Article 12. Import quarantine inspecti<strong>on</strong>1. When the imported articles arrive at the first point of entry, the articles owners haveresp<strong>on</strong>sibility to complete plant quarantine procedures in accordance with Article 8 of this<str<strong>on</strong>g>Decree</str<strong>on</strong>g>.2. <strong>Plant</strong> quarantine office which will carry out the procedures at the point of entry. Inspecial cases, the plant quarantine procedures may be carried out at other places with quarantinefacilities in compliance with legislative provisi<strong>on</strong>s;3. When vessels carrying regulated articles and reaching the water territory of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>,the vessel operator shall make declarati<strong>on</strong> for phytosanitary inspecti<strong>on</strong>; if no quarantine pest isfound, such vessel will be allowed to accommodate the water port; if a regulated pest is detected,they must undergo complete treatment.4. Articles temporarily imported or temporarily exported must go through plant quarantineprocedures like the imported articles.Article 13. Importati<strong>on</strong> of plant seeds and beneficial organisms1. Organizati<strong>on</strong>s and/or individuals that import plant seeds and beneficial organisms shallsatisfy the requirements as specified in Article 10 of this <str<strong>on</strong>g>Decree</str<strong>on</strong>g> and meet the followingc<strong>on</strong>diti<strong>on</strong>s:a) <strong>Plant</strong> seeds shall undergo quarantine procedures at the point of entry designated by thecompetent quarantine authority.b) As for plant seeds in the list permitted for growing and trading, they shall be transportedto and grown at the sites that have been registered with the plant quarantine authority. The saidorganizati<strong>on</strong>s and/or individuals shall report to the local plant protecti<strong>on</strong> and quarantine agenciesfor further m<strong>on</strong>itoring and checking pest status;c) As for new plant varieties imported for the first time, they may be grown <strong>on</strong>ly at aquarantine facility which is designated by the plant quarantine authorities for pest screening.


8d) In some special cases, permissi<strong>on</strong> of the Minister of Agriculture and Rural Developmentis required.2. Orginizati<strong>on</strong>s and/or individuals import plant for planting and beneficial organisms shallsatisty the m<strong>on</strong>itoring durati<strong>on</strong> for specific group of plant varieties prescribed in legislativeregulati<strong>on</strong>s.3. The m<strong>on</strong>itoring durati<strong>on</strong> for specific groups of plant varieties and beneficial organisms aswell as specificati<strong>on</strong>s of a standard quarantine facility shall comply with provisi<strong>on</strong>s of theMinistry of Agriculture and Rural Development.Article 14. M<strong>on</strong>itoring, movement, storage and use of imported articles1. The plant quarantine authorities are empowered to supervise quarantine of importedarticles as from the time such articles are brought into the <str<strong>on</strong>g>Viet</str<strong>on</strong>g>namese territory.2. The articles owners must have the phytosanitary certificate granted by <str<strong>on</strong>g>Viet</str<strong>on</strong>g>namese plantquarantine authorities and implement all measures described in such certificate during the processof transport, storage and use of the articles.Chapter IIIExport <strong>Plant</strong> <strong>Quarantine</strong>Article 15. Export plant quarantine basementsThe plant quarantine authority shall <strong>on</strong>ly c<strong>on</strong>duct phytosanitary inspecti<strong>on</strong> <strong>on</strong> exportedarticles in cases where:1. The commercial c<strong>on</strong>tract or internati<strong>on</strong>al agreements require quarantine procedures;2. The articles owners request plant quarantine certificati<strong>on</strong>.Article 16. Export quarantine inspecti<strong>on</strong>1. When the exported articles arrive at the final port or export terminal, the article ownersmust notify in advance the nearest and carry out quarantine inspecti<strong>on</strong> according with Article 8 ofthis <str<strong>on</strong>g>Decree</str<strong>on</strong>g>2. The plant quarantine authority shall carry out quarantine inspecti<strong>on</strong> at the designatedport. When inspecti<strong>on</strong> is c<strong>on</strong>ducted at the producti<strong>on</strong> site, departure site or storage facility, theowner shall present the phytosanitary certificate at the export terminal;


9Article 17. M<strong>on</strong>itoring of exported articles1. The quarantine authorities shall have the right to supervise the plant quarantine of exportarticles from the time the articles are inspected and granted with phytosanitary certificate untilthey are transported out of the territory of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>;2. During the process of shipment, the articles owners shall fully implement all measuresthat have been specified in the phytosanitary certificate.Chapter IVTransit <strong>Plant</strong> <strong>Quarantine</strong>Article 18. C<strong>on</strong>diti<strong>on</strong>s for c<strong>on</strong>signments in transit1. A phytosanitary certificate issued by the competent authority of the country of origin2. The c<strong>on</strong>signment in transit or using storage facilities in the territory of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> shall beagreed by the <str<strong>on</strong>g>Viet</str<strong>on</strong>g>namese plant quarantine authorities.3. The articles in transit must be packed with specific commodity c<strong>on</strong>figurati<strong>on</strong>s in order toprevent the spread of pests in the process of transportati<strong>on</strong> and storage.Article 19. <strong>Quarantine</strong> inspecti<strong>on</strong> of c<strong>on</strong>signments in transit1. When the articles in transit arrive at the first point of entry of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>, the articleowners shall inform the nearest plant quarantine office and present the phytosanitary certificate ofthe country of origin;2. The plant quarantine authorities of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> shall have the right to supervise sucharticles, inspect the c<strong>on</strong>veyance and the outside of the c<strong>on</strong>signment.3. If the articles transiting <str<strong>on</strong>g>Viet</str<strong>on</strong>g>nam are found with <str<strong>on</strong>g>Viet</str<strong>on</strong>g>nam’s plant quarantine objects orpacked improperly under the commodity specificati<strong>on</strong>s, without phytosanitary certificate oforigin country, the plant quarantine bodies have reposibility to inspect the articles and transportmeans or suspend the movement until re-packing meet the requirements. The <strong>Plant</strong> quarantineauthorities m<strong>on</strong>itor and inspect these cases for issuance of phytosanitary transit certificates.CHAPTER VDOMESTIC PLANT QUARANTINEArticle 20. C<strong>on</strong>tents of domestic plant quarantine1. Management of regulated pests and beneficial organisms in <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>;


2. Management and implementati<strong>on</strong> of treatment measures <strong>on</strong>ce pest outbreaks aredetected.3. Development and implementati<strong>on</strong> of effective pest record surveys, surveillance andc<strong>on</strong>trol programmes of regulated pests <strong>on</strong> imported seeds and stored plant products;Article 21. Procedure for domestic plant quarantine1. The declarati<strong>on</strong>, inspecti<strong>on</strong>, treatment and granting of domestic phytosanitary certificatesshall comply with Article 8 of this <str<strong>on</strong>g>Decree</str<strong>on</strong>g>.2. Domestically produced seeds that neither come from nor move through outbreak areasshall not be subject to quarantine procedures in the process of domestic movement.Article 22. M<strong>on</strong>itoring domestic quarantine1. Undertake regular observati<strong>on</strong>s, surveillance and m<strong>on</strong>itoring of pest status <strong>on</strong> importedplant seeds and stored plant products;2. When plant seeds and/or beneficial organisms are introduced for growing or release, thelocal competent plant protecti<strong>on</strong> and quarantine agencies shall:a) Check records associated with plant seeds and/or beneficial organisms;b) M<strong>on</strong>itor and supervise places of growing and/or release;c) If the owners of imported articles fail to comply with the provisi<strong>on</strong>s, the local competentagencies shall take phytosanitary measures in accordance with legislative provisi<strong>on</strong>s;3. Establish the boundaries of pest outbreak area, determine places for domestic quarantineinspecti<strong>on</strong> of articles transported from the outbreak area, issue domestic phytosanitarycertificates, supervise the movement of regulated articles out of the outbreak area;4. Check phytosanitary certificates and supervise c<strong>on</strong>signments brought from the outbreakarea to local fields;5. Determine measures for treatment of articles infested with regulated pests; provideguidance and supervise the articles owners in the implementati<strong>on</strong> of treatments;6. When pest outbreak becomes spreading, the local competent agency shall immediatelyreport thereof to the authority resp<strong>on</strong>sible for declaring the outbreak as provided for in Article 11of the Ordinance <strong>on</strong> <strong>Plant</strong> Protecti<strong>on</strong> and <strong>Quarantine</strong>.10


11Chapter VITREATMENT OF REGULATED ARTICLESArticle 23. Treatment of regulated articles1. Treatment of articles involves such measures as processing, selecti<strong>on</strong>, sorting, cleaning,disinfestati<strong>on</strong>, return to the place of origin, disposal and other measures for the purpose oferadicati<strong>on</strong> of regulated pests.2. The phytosanitary treatments must be applied in accordance with legislative provisi<strong>on</strong>s ofcompetent plant protecti<strong>on</strong> and quarantine authorities.Article 24. Treatment of imported articles1. The treatment of articles infested with regulated pests shall be c<strong>on</strong>ducted as follows:a) If the articles infested with a pest in the list of regulated pests but not present in theterritory of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>, or with a new pest, such articles shall not be allowed for import and mustbe returned to the place of origin or be destroyed. Where absolute treatments are available, suchmeasures may be applied;b) If the articles infested with a pest in the list of regulated pests but not widely distributedin the territory in <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>, or infested with a pest appeared in the list of regulated n<strong>on</strong>quarantinepests of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>, absolute treatment measures shall be decided by the plantquarantine authority. Where treatments are not feasible in <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>, the c<strong>on</strong>signment shall bereturned to the place of origin or destroyed.2. The plant quarantine authority is resp<strong>on</strong>sible for, in coordinati<strong>on</strong> with local governmentsand other agencies c<strong>on</strong>cerned, the treatment of foreign articles adrift, dropped, discarded orleaked into <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g>.Article 25. Treatment of export, in transit and domestic movement articles1. The treatment of exported articles shall be c<strong>on</strong>ducted at the request of the article ownersor in accordance with phytosanitary requirements of the importing countries or commercialc<strong>on</strong>tracts.2. If a quarantine pest of <str<strong>on</strong>g>Viet</str<strong>on</strong>g> <str<strong>on</strong>g>Nam</str<strong>on</strong>g> is intercepted or the articles are not packed with specificcommodity c<strong>on</strong>figurati<strong>on</strong>s, the owner shall c<strong>on</strong>duct treatment or repack the articles in anappropriate manner.3. Treatment of infested articles in domestic phytosanitary activities shall be c<strong>on</strong>ducted bythe decisi<strong>on</strong>s of competent quarantine authoritiesArticle 26. Fumigati<strong>on</strong>the fumigati<strong>on</strong> organizati<strong>on</strong>s shall fully meet the following requirements:1. The manager or operator of the facility must obtain Fumigati<strong>on</strong> Practice Certificate;
