46. The service provider shall be solely responsible for payment of wages/salaries,other benefits, allowances and all other statutory/ other dues payable as perCentral/ State Government/ Municipality Rates etc., other laws etc. as applicable topersonnel deployed that might become applicable under any Act or Order of theGovernment. The Income Tax Department shall have no liability whatsoever in thisregard.7. The Service provider shall comply with all applicable laws of the Central Govt.,State Govt. and any other law for the time being in force including the Service TaxLaw. This Office will not be responsible for any dispute that may arise in connectionwith the subject service, between the service provider relating to Laws, Service Tax,Income Tax, etc. or any local body.8. The Service provider shall be solely responsible for any/ all disputes between himand the personnel deployed by him. The Department will not entertain any suchdispute and there should be no claim or liability against the department or any of itsofficers on this account and he will keep the department indemnified against allactions.9. Department reserves right to accept/reject any tender or all tenders withoutassigning any reason.10. Service provider shall ensure that the personnel deployed by him do not have anycriminal antecedents and should be of sound health and below the age of 55 years.11. For any losses, damages caused by the personnel deployed by the serviceprovider, to any person/ property/ equipment of the office, the service provider willhave to make good such loss/ damage and bear the expenses for such loss/damage as decided by the Competent Authority. Further, in respect of such loss/damage, the Income Tax Department reserves the right to take such further actionas required/ provided under the Law.12. The Income Tax Department shall not entertain any claim, damages, insuranceliability, etc. arising out of mishap/ accident etc. to the personnel employed by thevendor. The vendor will take such necessary action, under the various Acts/ Rules/Law as required to take care of personnel deployed including medical treatment andtransportation to hospital etc. as and when required.13. The service provider shall in no case lease/ transfer/ sublet/ appoint caretaker forthe services rendered.14. The service provider should specifically note that the engagement of the serviceprovider under this contract does not in any way confer any right on the Serviceprovider or the persons that may be deployed by him in this office, for claiming anyregular employment in this office or any other Government Office. The Serviceprovider should also obtain a written undertaking from the persons deployed by himto work in this office that they are fully aware that their deployment to work in thisoffice does not confer any right on them for claiming any regular employment in thisoffice or any other Government Office.15. In case of any default by the Service provider in respect of any of the Terms &Conditions, (Whether General or Special), the Chief Commissioner of Income-taxmay without prejudice to any other right/ remedy which shall have accrued or shallaccrue thereafter, terminate the contract, in whole or part, by giving 15 days noticein writing to the service provider. The said notice will be deemed to have been
5issued if a Registered Copy of Notice is sent to the address of the service provideras per the Agreement.16. The Chief Commissioner of Income-tax reserves the right to terminate the contract,by giving 15 days notice in writing without assigning any reasons and withoutincurring any financial liability whatsoever to the Service Provider.17. Manpower required for execution of the entire work daily including transport ofpersonnel deployed to the office/site will be arranged by the service provider if thepersonnel are not able to attend work or his services are not found satisfactory, itwould be the responsibility of the service provider to provide another suitableworkman in his place.18. Attendance register of the personnel deployed will be maintained by the Serviceprovider. The personnel shall render service everyday for all 24 hours (3 Shifts of08 hours each) including all holidays. They will also attend to any unforeseen jobsas well as exigency of work. No extra payment for this shall be made.19. The Service provider shall conduct periodical inspection of security personnel onduty to ensure discipline, punctuality and efficiency.20. No transport, TA/DA, insurance, medical facility shall be provided by the IncomeTax Department.21. These terms and conditions are only explanatory as such after finalization ofquotations by the Department, a written agreement shall be made between theDepartment and service provider for which appropriate stamp paper shall bepurchased by the service provider. The agreement shall be enforced for a normalperiod of three months and may be extended from time to time after reviewing theservices of service provider.22. Medical Certificate for each guard is to be furnished.23. The Sealed tender/ quotation/ proposals addressed to the Public Relations Officer,O/o the Chief Commissioner of Income-tax, R.No. 107, Aayakar Bhavan, Paota CRoad, Jodhpur – 342010 super scribed by “Tender for providing security services”must reach this office by on or before 11.00 a.m. on or before 24.07.2013. Thetenders will be opened by the Department on 24.07.2013 at 11.30 a.m. at the RoomNo 76, Conference Hall, Aayakar Bhavan, Paota C Road, Jodhpur – 342010.Interested service providers are requested to attend the opening of the Sealed Bids/Proposal/ quotations at the appointed date and time.-sd-(R M Vasavada)Asst.
