• Will undertake joint consultation with affected landowners and residents.• Will consider the outcome <strong>of</strong> the consultation and agree to support the joint submission tothe Local Government Advisory Board.Nature <strong>of</strong> ProposalThe proposal by the two cities is to change the boundary between the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> and the<strong>City</strong> <strong>of</strong> Swan for the area north <strong>of</strong> Widgee Road to Reid Highway and west <strong>of</strong> Tonkin Highway toAlexander Drive, so the new boundary follows the alignment <strong>of</strong> Tonkin Highway and Reid Highway.The effect <strong>of</strong> this proposal is that the suburb <strong>of</strong> <strong>Noranda</strong> would be located wholly within the <strong>City</strong><strong>of</strong> <strong>Bayswater</strong>. The proposed boundary change complies with all relevant regulations - Schedule2.1 – clause 2(2)(a) the Local Government Act 1995.In accordance with the requirements <strong>of</strong> Schedule 2.1 – clause 2(2)(b) <strong>of</strong> the Local GovernmentAct 1995, an area map, illustrating the proposed changes, is shown at the bottom <strong>of</strong> page 1.BACKGROUNDReason for the ProposalIn February 2009, the Minister for Local Government, the Hon John Castrilli MLA, announced asuite <strong>of</strong> measures to facilitate local government reform within Western Australia. This initiativerequired that local governments undertake a staged process <strong>of</strong> reform with key submissions,including a sustainability checklist, required by 30 April 2009 and final submissions for change dueon 31 August 2009 (this date was later extended to 30 September 2009).Following submission <strong>of</strong> the checklist in April 2009, the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> was advised(in July 2009) that it had been given a Category 1 classification. The <strong>City</strong> <strong>of</strong> Swanwere also classed as Category 1, this classification states that “there is an existingorganisational and financial capacity to meet current and future community needs.Local governments should still consider reform opportunities which enhance service provision tolocal and regional communities”.DRAFTIn response to the local government reform process, the <strong>City</strong> <strong>of</strong> Swan, at its Ordinary CouncilMeeting held on 23 September 2009, proposed that the existing boundary between the Cities <strong>of</strong><strong>Bayswater</strong> and Swan be amended to follow the alignment <strong>of</strong> Tonkin Highway and Reid Highway.The new alignment would mean that the whole <strong>of</strong> the suburb <strong>of</strong> <strong>Noranda</strong> would be located withinthe <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>. The current boundary divides the suburb between the two cities.Support <strong>of</strong> the Two Cities for the ProposalOn 25 November 2010, the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> received a letter from the <strong>City</strong> <strong>of</strong> Swan reiteratingthe progressing <strong>of</strong> this submission being that the existing boundary between the two cities - alongWidgee Road, <strong>Noranda</strong> - be amended so the boundary follows the alignment <strong>of</strong> Tonkin Highwayand Reid Highway. The <strong>City</strong> <strong>of</strong> Swan further requested the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> Council refer thismatter to the Local Government Advisory Board for their consideration.The <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> at its Ordinary Meeting <strong>of</strong> Council on 14 December 2010 resolved that:1. The Minister for Local Government be advised that the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> supports the <strong>City</strong><strong>of</strong> Swan on the boundary change being the area north <strong>of</strong> Widgee Road to Reid Highway andwest <strong>of</strong> Tonkin Highway to Alexander Drive being transferred to the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>.2. The <strong>City</strong> <strong>of</strong> Swan be advised that the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> supports its proposal.3. approval.As part <strong>of</strong> its deliberations, the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> considered:• Correspondence from Mr Ross Earnshaw, Manager Reform Implementation, informingCouncil that - should the <strong>City</strong> still wish to progress boundary amendments prior to anydecision on the review panel, a formal proposal will need to be submitted to the Board inaccordance with Schedule 2.1 <strong>of</strong> the Local Government Act 1995.• The letter from the <strong>City</strong> <strong>of</strong> Swan; and• A map showing the proposed boundary change.On 24 December 2010, the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> wrote to:• The <strong>City</strong> <strong>of</strong> Swan advising <strong>of</strong> the outcome <strong>of</strong> the Ordinary Meeting <strong>of</strong> Council held on14 December 2010; and• Mr Melvyn Congerton, Chairman <strong>of</strong> the Local Government Advisory Board.On 25 January 2011, the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> received a letter from the Minister for Local Governmentacknowledging the <strong>City</strong>’s letter and advising the <strong>City</strong> <strong>of</strong> the requirements under the provisions <strong>of</strong>Schedule 2.1 <strong>of</strong> the Local Government Act 1995.BOUNDARY CHANGE - LOCAL GOVERNMENT ACT 1995, SCHEDULE2.1 - CRITERIACommunity <strong>of</strong> InterestThe suburb <strong>of</strong> <strong>Noranda</strong> is relatively remote from the <strong>City</strong> <strong>of</strong> Swan’s Midland regional centre.<strong>Noranda</strong>’s proximity to Morley <strong>City</strong> Centre and its major road links means that residents looktowards the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> for access to major retail and leisure opportunities.DRAFTThe major road connections, such as Tonkin Highway and Alexander Drive, provide rapid accessto the Centro Galleria Shopping Centre in Morley and to leisure facilities such as the <strong>Bayswater</strong>Waves Aquatic Centre, Morley Sports and Recreation Centre, <strong>Noranda</strong> Palms Shopping Centreand the Gerry Leeuwangh (Morley) Library.Reinforcing the affected community’s focus on Morley, <strong>Noranda</strong> is also within Morley Senior HighSchool’s catchment area.Although within the <strong>City</strong> <strong>of</strong> Swan’s current boundary, the Lightning Park Recreation Centre andLightning Swamp Bushland areas in <strong>Noranda</strong> are managed by and vested in the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>.The <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> constructed the Lightning Park Recreation Centre at a cost <strong>of</strong> $4.6 million.The facility provides valuable recreation services to the suburbs <strong>of</strong> Ballajura, Malaga, Beechboro,Kiara, Lockridge and <strong>Noranda</strong>. This multipurpose recreation centre provides facilities for the<strong>Noranda</strong> Junior Football Club, East Perth Development Squad, the <strong>Noranda</strong> EDU Senior FootballClub and the Morley Tee Ball Association.The recreation centre’s neighbouring bushland is considered environmentally significant in terms<strong>of</strong> its flora and fauna and the area is cared for by the Friends <strong>of</strong> Lightning Swamp – a grouppredominantly comprising residents from the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>.Page 3Proposed Local Government Boundary Change <strong>Noranda</strong>


Physical and Topographical FeaturesThe proposed change will simplify the boundary between the cities by ensuring it is marked bysignificant arterial roads.The Tonkin and Reid Highways are major, established physical features and the proposed alterationto utilise these highways as boundaries clearly identifies and distinguishes the boundary betweenthe two cities.Demographic trendsThe demographic characteristics <strong>of</strong> the subject area is almost identical to that <strong>of</strong> the remainingportion <strong>of</strong> <strong>Noranda</strong> within the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>. It is recognised that Australia’s population isaging rapidly and the populations <strong>of</strong> the Cities <strong>of</strong> <strong>Bayswater</strong> and Swan are no exception to thistrend. The <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> has extensive facilities to cater for the aged and has a proven trackrecord in the provision <strong>of</strong> high quality services to the aged.Economic FactorsThe Morley Strategic <strong>City</strong> Centre is the nearest and most accessible retail, entertainment andeconomic hub to the suburb <strong>of</strong> <strong>Noranda</strong>.The <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> has adopted a Masterplan for the Morley <strong>City</strong> Centre to address future landuse to foster further development <strong>of</strong> this strategic area.Morley <strong>City</strong> Centre’s continuing development will strengthen its role as a shopping and entertainmentdestination, and potential employment hub for the <strong>Noranda</strong> community.In addition, WAPC’s “Directions 2031 Spatial Framework for Perth and Peel” supports furtherstrengthening <strong>of</strong> Morley’s public transport connections.Morley’s Strategic Metropolitan Centre classification is in the highest order activity centreclassification in the Metropolitan Centre Hierarchy, other than Perth Central Business District.DRAFTHistory <strong>of</strong> the AreaLightning Park Recreation Centre - serving the needs <strong>of</strong> <strong>Noranda</strong> residentsPrior to the 1970s, <strong>Noranda</strong> was a largely rural area and included a number <strong>of</strong> poultry farms.The area was identified as “urban deferred” under the Metropolitan Region Scheme. However,planning for residential development <strong>of</strong> the suburb <strong>of</strong> <strong>Noranda</strong> began in the early 1970s as part <strong>of</strong>the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>’s Town Planning Scheme No. 17.The first stage <strong>of</strong> residential development was subsequently settled in 1979, with further stagesopening during the 1980s, including three school sites - one for a high school and two for primaryschools - to serve its young population.Page 4Proposed Local Government Boundary Change <strong>Noranda</strong>


Although within the <strong>City</strong> <strong>of</strong> Swan’s current boundary, the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> began work to developthe Lightning Park Recreation Centre in the 1990s to serve the recreational needs <strong>of</strong> a number <strong>of</strong><strong>Noranda</strong> sporting clubs and associations. The <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> constructed the centre at a cost<strong>of</strong> $4.6 million and opened the new facility in 2008. This multipurpose recreation centre providesfacilities for the <strong>Noranda</strong> Junior Football Club, East Perth Development Squad, the <strong>Noranda</strong> EDUSenior Football Club and the Morley Tee Ball Association.Transportation and CommunicationReid Highway/Tonkin Highway, Collier Road/Wellington Road, Central Avenue, Morley Drive andBenara Road are all important cross-links connecting <strong>Noranda</strong> with the Morley <strong>City</strong> Centre andthe wider <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>.Future growth <strong>of</strong> Morley as a key “activity centre” within the north Metropolitan area will seegreater focus on the centre developing in all forms including a major transport hub for both publicand private modes <strong>of</strong> transport.Local Government ViabilityThe proposed change to the boundary is relatively minor in nature and is not expected to have anegative impact on either local government. It should be noted that both the Cities <strong>of</strong> <strong>Bayswater</strong>and Swan have been assessed as Category 1 by the Department for Local Government. Thismeans they have been assessed as having “… an existing organisational and financial capacityto meet current and future community needs”.The Lightning Park Recreation Centre and the Class ‘A’ Lightning Swamp Reserve are alreadyvested in and managed by the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>. The additional rates, estimated at approximately$500,000, is considered sufficient to cover the cost <strong>of</strong> the services that will be provided by the <strong>City</strong><strong>of</strong> <strong>Bayswater</strong> and some minor economies <strong>of</strong> scale may be achieved as a result <strong>of</strong> the boundarychange.DRAFTEffective Delivery <strong>of</strong> Local Government ServicesThe proposed realignment would affect approximately 535 properties and generate some $0.5million in rate revenue for the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>, thus it would be reasonable to support the Cities<strong>of</strong> <strong>Bayswater</strong> and Swans proposal.The Cities <strong>of</strong> <strong>Bayswater</strong> and Swan have a history <strong>of</strong> sharing services and resources and in thisrespect both Councils contribute to the cost <strong>of</strong> operating the Altone Park Recreation Centre in the<strong>City</strong> <strong>of</strong> Swan.<strong>Noranda</strong> residents already utilise many <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>’s recreational services such asthe Lightning Park Recreation Centre, <strong>Bayswater</strong> Aquatic Centre, Morley Sports and RecreationCentre, Crimea Skate Park and the Gerry Leeuwangh (Morley) Library.The area impacted by the boundary change includes the Class A Lightning Swamp Reserve that isalready vested in the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> and is one <strong>of</strong> 145 passive reserves managed by the <strong>City</strong>.The area affected by the proposed boundary change currently forms part <strong>of</strong> the <strong>City</strong> <strong>of</strong> Swan’sBallajura Ward and landowners and residents are represented by three Ward Councillors. Upontransfer to the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> landowners and residents would be represented by the threeNorth Ward Councillors.Page 5Proposed Local Government Boundary Change <strong>Noranda</strong>


IMPLEMENTATIONGeneralThe <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> and <strong>City</strong> <strong>of</strong> Swan have agreed to work together to ensure the smoothtransition <strong>of</strong> the land covered by the boundary change in relation to the following:• Town Planning Scheme - incorporating the area into the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>’s town planningregime.• Rating - transferring rates records.• Records Management – getting records transferred across.The <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> has the demonstrated capacity and capabilities to ensure the smoothtransition <strong>of</strong> an area affected following a boundary change.The highly successful transfer <strong>of</strong> the suburb <strong>of</strong> Maylands from the <strong>City</strong> <strong>of</strong> Stirling to the <strong>City</strong> <strong>of</strong><strong>Bayswater</strong> in 1998 provides a model for managing the change.Ward RepresentationElectors in this area would fall into the North Ward for the purpose <strong>of</strong> local government elections.The addition <strong>of</strong> these 535 properties will not significantly alter the elector / councillor ratio and isconsistent with the requirements <strong>of</strong> the Act and Regulations.Transitional Arrangements in Accordance with Clause 11 <strong>of</strong> Schedule 2.1The proposed boundary change has the support <strong>of</strong> both local governments and the Cities <strong>of</strong><strong>Bayswater</strong> and Swan will work together on the transitional arrangements, including the timetable,for the boundary change to take place.These transitional arrangements will include, but will not be limited to, consideration <strong>of</strong>:DRAFT• Human resource implications in terms <strong>of</strong> service standards and staff structure.• Service delivery implications for plant and equipment.• Financial arrangements - including transitional costs, any implications for the respectivelocal governments’ reserves, short and long term liabilities and the collection <strong>of</strong> rates.• Transfer <strong>of</strong> land and assets, including any facilities located within the boundary changearea.• Governance issues, and the requirement for amendments to local laws and town planningschemes.• Ward and Elected Member representation.Page 6Proposed Local Government Boundary Change <strong>Noranda</strong>


RECOMMENDATIONSFollowing the outcome <strong>of</strong> consultation, proposed recommendations are:1. The Local Government Advisory Board support the proposed boundary change betweenthe Cities <strong>of</strong> <strong>Bayswater</strong> and Swan - to change the boundary between the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>and the <strong>City</strong> <strong>of</strong> Swan for the area north <strong>of</strong> Widgee Road to Reid Highway and west <strong>of</strong> TonkinHighway to Alexander Drive, so the boundary follows the alignment <strong>of</strong> Tonkin Highway andReid Highway, such that the whole suburb <strong>of</strong> <strong>Noranda</strong> is within the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>.{Schedule 2.1 – clause 2(2)(a) <strong>of</strong> the Local Government Act 1995}.2. The Local Government Advisory Board, in supporting the proposed boundary change,determine by absolute majority, in accordance with Schedule 2.1, clause 3(3), that theproposal is:-a. One <strong>of</strong> a minor nature; andb. Not one about which further public submissions need to be invited, dependant on theoutcome <strong>of</strong> public consultation being jointly undertaken as part <strong>of</strong> the joint submission bythe <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong> and <strong>City</strong> <strong>of</strong> Swan.3. The Local Government Advisory Board support finalising the boundary changes and seekMinisterial approval.4. The area affected by the boundary change form part <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Bayswater</strong>’s NorthWard.5. The Local Government Advisory Board notes that relevant reviews <strong>of</strong> ward boundarieswould occur in each authority in accordance with statutory requirements.DRAFT
