However<strong>the</strong> private party isgiven some protectionagainst adverserevenue effects(section 18.3.5).Government shouldconsider <strong>the</strong> need <strong>for</strong>monetary limits on <strong>the</strong>size <strong>of</strong> variations(section 13.2.8). Theprivate party shouldbe entitled <strong>to</strong> refuse <strong>to</strong>implement a variationin certaincircumstances,including if it wouldmaterially andadversely change <strong>the</strong>nature <strong>of</strong> <strong>the</strong> project(section 13.3.4).The private partyshould be entitled <strong>to</strong>ve<strong>to</strong> any variation thatadversely affects <strong>the</strong>risk pr<strong>of</strong>ile <strong>of</strong> <strong>the</strong>project <strong>for</strong> <strong>the</strong> privateparty (sections 50.2.3;50.3.6-8).Variations must notexceed 5% <strong>of</strong> <strong>the</strong> <strong>to</strong>talproject cost and mustnot affect <strong>the</strong>commercial operationdate (clause 17.1).A monetary limit isspecified <strong>to</strong> restrict<strong>the</strong> size <strong>of</strong> variationsduring <strong>the</strong>construction stage(clause 7.1). During<strong>the</strong> operations stage<strong>of</strong> <strong>the</strong> project, a“capacityaugmentation”process applies,under whichgovernment invitesbids <strong>for</strong> augmentation<strong>of</strong> <strong>the</strong> project(clause 10.1). Theprivate party is notrequired <strong>to</strong> bid, but if itis not <strong>the</strong> successfulbidder <strong>for</strong> <strong>the</strong>augmentation, itsconcession isterminated and itreceives a terminationpayment(clause 10.2).Page 15 <strong>of</strong> 35Foster Infrastructure
