(Dok A sa Dok C2) flimkienmal-imgħax ulterjuri, mill-1 ta’ Ottubru 1998, sad-data taleffettivpagament.Bl-ispejjeż ...omissis… il-konvenuti inġunti in subizzjoni.Illi permezz tan-Nota tal-Eċċezzjonijiet tagħhom ilkonvenutieċċepew.…omissis…Illi permezz ta’ sentenza mogħtija mill-Onorabbli Prim’Awlatal-Qorti Ċivili, fis-27 ta’ Ottubru 2006, dik il-Qorti ċaħdet l-eċċezzjonijiet kollha tal-konvenuti appellanti, ħlief għal dikdwar l-imgħaxijiet komposti.Illi permezz ta’ sentenza mogħtija mill-Onorabbli Prim’Awlatal-Qorti Ċivili, fit-3 ta’ Ottubru 2008, l-Onorabbli Prim’Awla tal-Qorti Ċivili, ċaħdet ukoll l-aħħar eċċezzjoni li kien fadal u ċioèdik dwar l-imgħaxijiet komposti u kkundannat …omissis…Illi l-imsemmija tlett konvenuti Pyramid Hotels Limited,William Caruana u Cloisters Walk Limited, interponew Appell,quddiem din l-Onorabbli Qorti tal-Appell, mis-sentenza fuqimsemmija u liema Appell huwa msejjes unikament fuq l-aggravju tal-imgħaxijiet komposti.Illi l-esponenti l-ewwel nett tissotometti illi l-Appell huwafrivolu u vessatorju u dan għar-raġunijiet segwenti.Illi l-esponenti tagħmel riferenza għal komputazzjonijietli hija ppreżentat, quddiem l-Ewwel Onorabbli Qorti, insegwitu għas-sentenza tas-27 ta’ Ottubru 2006, fejn ġietordnata tippreżenta prospetti u bilanċi li jirrispekkjaw kemmil-bilanċ dovut, bl-imgħaxijiet sempliċi, kif ukoll dak dovutbl-imgħaxijiet komposti u l-esponenti tagħmel hawn riferenzagħal dik in nota, ippreżentata, fl-atti fit-23 ta’ Frar 2007. Minnhemhekk jirriżulta li (a) jekk il-kontijiet jinħadmu fuq bilanċsempliċi mill-bidu tal-kontijiet rispettivi sal-1 ta’ Ottubru 1999,il-bilanċ dovut ilaħħaq is-somma ta’ €2,088.895.90 u (b) jekkil-bilanċ jinħadem b’imgħax sempliċi, fir-rigward ta’ LoanAccount u imgħax kompost fir-rigward ta’ Overdraft Accountsal-jum tal-1 ta’ Ottubru 1999, dan il-bilanċ ilaħħaq is-somma ta’€2,096,951.06. Issa dan l-Appell qed isir mis-soċjetà PyramidHotels Limited, minn William Caruana u mis-soċjetà Cloisterspay the plaintiff company the sum of €2,134.828.02 balance ofdebt with the Bank of Valletta p.l.c. together with interest fromthe 1st October 1999, till the date of effective payment.2. Condemn the defendant William Caruana together ‘insolidum’ with the company ‘Pyramid Hotels Limited, to pay theplaintiff the sum of €1,555.998.14 balance of debt in the ‘Loanand Overdraft Accounts’ of Pyramid Hotels Limited, with theBank of Valletta p.l.c. …omissis... together with further interest,from the 1st October 1998, till the date of effective payment.…omissis…7. Condemn the defendant company Cloisters Walk Limited,together and ‘in solidum’ with the company Pyramid HotelsLimited, to pay the plaintiff the sum of €465,874.68 balance ofdebt with the Bank of Valletta p.l.c. (Doc A to Doc C2) togetherwith further interest, from the 1st October 1998, till the date ofefffective payment.With costs …omissis… the defendants are summoned sothat a reference to their evidence be made.That by their Note of Pleas the defendants pleaded.…omissis…That by means of a judgement given by this HonourableCourt First Hall, on the 27th October 2006, that Court rejectedall the pleas of the appellant defendants, except those regardingcompound interest.That by means of a judgement given by the Honourable FirstHall Civil Court, on the 3rd October 2008, the Honourable FirstHall Civil Court, rejected also the last plea which remained andnamely that of compound interests and condemned …omissis…That the said three defendants Pyramid Hotels Limited,William Caruana and Cloisters Walk Limited, filed an Appeal,before this Honourable Court of Appeal, from the judgementabove mentioned and which Appeal is based solely on thegrievance of compound interests.That the applicants in the first place submit that the Appeal isfrivolous and vexatious and this for the following reasons.That the applicants refer to the computation which theypresented before the Honourable First Court, following ajudgement of the 27th October 2006, whereby it was ordered topresent prospectus and balances which reflect both the balancedue, with simple interests, as well as that due by compoundinterest, and the applicants hereby refer to that note presentedin the records of the 23rd February 2007. From there it resultsthat (a) if the accounts are worked out on simple balances fromthe beginning of the respective accounts till the 1st October1999, the balance due shall amount to €2,088.895.90 and (b)if the balance is worked out on the basis of simple interest, asregards the Loan Account and compound interest as regardsthe Overdraft Account till the day of the 1st October 1999, thisbalance shall amount to €2,096.951.06.
