Should the person who is the subject of the report fail to attend the hearing, the hearing shall takeplace in the absence of that person and the fact of the failure to attend shall be taken into account inthe determination of the appropriate penalty in the event that an offence is found to have beencommitted.4 THE DECISIONThe decision should be in writing and read to the person the subject of the report by the <strong>Tournament</strong>Director (through an interpreter if necessary). It should deal (at least) with the following matters:abwhether or not the team member accepts the breach of the Code of Conduct;if the team member does not accept the breach, a finding as to whether a breach has occurredand why.Should it be found (or agreed) that an offence has been committed either the minimum penalty will beimposed or, at the entire discretion of the <strong>Tournament</strong> Director, a greater penalty. If a greater penaltyis being considered then :abcdthe disciplinary history of the team member;the attitude of the team member at the hearing;any penalty already incurred, eg if a card was given during the match the length of time of anysuspension served under that card;the seriousness of the offence by comparison with other offences at this levelwill be taken into account by the <strong>Tournament</strong> Director in imposing a greater penalty and details ofwhich will be set out in the written decision.5 DEFINITION OF THE PENALTYA clear definition of the penalty will include:abcdthe number of matches for which the team member is suspended;the date of commencement of the suspension;the match or matches to which the suspension shall apply (eg <strong>FIH</strong> events, any match played bythe team member’s National Association etc);any terms of the penalty in addition to suspension(for example referral to the <strong>FIH</strong> ChiefExecutive Officer for further consideration by the <strong>FIH</strong> Disciplinary Commissioner of thebehaviour constituting the offence).<strong>FIH</strong> <strong>Tournament</strong> <strong>Regulations</strong>:Outdoor Competitions – June 2013Page 39
