That this is the application of North Fork Exploration, LLC,for an Order pooling the interests and adjudicating the rights andequities of oil and gas owners in the Cromwell , Jefferson , Mississippian ,Woodford , Misener , Hunton , Viola , Simpson Dolomite , Wilcox and Arbucklecommon sources of supply underlying Section 8, Township 10 North, Range9 East, Okfuskee County, Oklahoma . The respondents named in this Orderare listed on the Exhibit "A" attached hereto . The following respondentswere dismissed from the purview of this order : A . P . Martin Trust ; AlvinAnn Jenkins McDaniel ; Barbara Dismukes ; Maxine Kingsbury ; Oneida L .Hanson ; Russell S . Miller Trust ; Virgil E . Glass ; Wayne O . The Administrative Law Judge has examined the notices bypublication, the publishers' affidavits of publication thereof, and theaffidavits of mailing and the Administrative Law Judge conducted ajudicial inquiry into the sufficiency of Applicant's search to determinethe names and whereabouts of the respondents who were served bypublication and based upon the evidence adduced, the Commission findsthat Applicant has exercised due diligence and has conducted a meaningfulsearch of reasonably available source at hand . The Commission herebyapproves the publication service given herein as meeting the statutoryrequirements, rules of the Commission and minimum standards of state and

That the land described in paragraph 1 above is a drilling andspacing unit for the common sources of supply also named in paragraph 1by drilling and spacing Order No . 561784 .4 . That Applicant and Operator, owners of the right to drill onsaid drilling and spacing unit, have not agreed with all of the otherowners in the drilling and spacing unit . The Applicant and Operatorrequest the Corporation Commission issue an Order requiring such ownersto pool their interest and develop the drilling and spacing unit as aunit and common sources of supply covered hereby .5 . That Applicant and Operator proposes to develop said unit andthe common sources of supply therefore by the drilling of a unit well orwells if hereinafter authorized to be drilled on the drilling and spacingunit thereon and, to avoid the drilling of unnecessary wells and toprotect correlative rights, all owners should be required to pool anddevelop the unit and common sources of supply covered hereby, upon theterms and conditions set out in "Order" below, all of which are foundhereby, after a consideration of the substantial evidence in this Cause,to be just and reasonable and will afford each owner in the unit theopportunity to recover or receive without unnecessary expense his justand fair share of the production from the unit .6 . That in the interest of the prevention of waste and theprotection of correlative rights, this Application should be granted, andthe rights of all owners pooled and adjudicated on a unit basis .ORDERIT IS THEREFORE ORDERED by the Corporation Commission of Oklahomaas follows :1 . That Operator proposes to develop as a unit Section 8 , Township10 North , Range 9 East , Okfuskee County , Oklahoma , a drilling and spacingunit for the Cromwell , Jefferson , Mississippian , Woodford , Misener ,Hunton , Viola , Simpson Dolomite , Wilcox and Arbuckle common sources ofsupply, and to develop said unit and the common sources of supplytherefore, and the rights and equities of all oil and gas owners coveredhereby are pooled, adjudicated, and determined .la . SPECIAL PROVISION : The witness for the Applicant testifiedthat large volumes of water shall be produced by the proposed unit well .For this reason a disposal well is required in the production of thehydrocarbons underlying the unit . To participate in the development ofthe unit and common sources of supply defined by this order, aparticipant shall be required to participate in the drilling andcompletion of the disposal well . The witness further testified that ifsufficient capacity is available, the Operator shall have the only rightto authorize the disposal of water from additional well or wells into thedisposal well . Should the Operator authorize the additional well orwells to dispose of water into the existing disposal well, then theworking interest owners in the additional well or wells shall acquire anownership in the disposal well by remitting their proportionate share ofactual well cost of the disposal well in relation to the number ofwell(s) currently disposing of water into the disposal well . All moniesreceived by the Operator from such working interest owners in suchadditional well or wells as well costs for such disposal well shall beimmediately paid as reimbursement to the current owners of the disposalwell in proportionate to their then current ownership in such disposalwell . It is further understood that the Operator shall only be allowedto charge actual cost of water disposed into the disposal well, plus areasonable charge for supervision and overhead, to the current owners ofthe producing well(s) .

That estimated well costs for a horizontal well toproduce from the Misener andfor Hunton are :Completed for production - $ 2,141,500 .0 0Completed as a dry hole - $ 1 , 397 , 500 .0 0The estimated well costs for a disposal well that is requiredto dispose of the water attributed to the production from the formationsdefined in this order are :Disposal Well Completed fo rdisposal of water - $2,398,000 .0 0Disposal Well drilled bu tnot complete - $1,661,500 .0 0b . An owner can elect $ 135 . 00 per acre cash with a 1/ 8royalty . The $135 .00 per acre cash with a normal 1/ 8royalty is a fair, reasonable, and equitable bonus to b epaid unto each owner who elects not to participate i nsaid well or wells if hereinafter authorized to b edrilled on the drilling and spacing unit by paying suchowner's proportionate part of the cost thereof ; suchcash bonus plus overriding or excess royalty, when pai das set out in this Order, is satisfaction in full fo rall rights and interests of such owner in the uni tcovered hereby as defined .in 52 O .S ., Section 87 .1(e) .c . An owner can elect $ 110 . 00 per acre cash with a 3/1 6royalty . The $110 .00 per acre cash with a normal 1/ 8royalty, plus an additional .1/16 of 8/8 override, is afair, reasonable, and equitable bonus to be paid untoeach owner who elects not to participate in said well o rwells if hereinafter authorized to be drilled on th edrilling and spacing unit by paying such owner' sproportionate part of the cost thereof ; such cash bonu splus overriding or excess royalty, when paid as set ou tin this Order, is satisfaction in full for all right sand interests of such owner in the unit covered hereb yas defined in 52 O .S ., Section 87 .1(e) .PROVIDED, that each owner of the right to drill in saiddrilling and spacing unit who elects to accept eitherparagraph 2b or 2c defined above shall relinquish unto theOperator all of owners right, title and interest as definedabove in said well or wells if hereinafter authorized to bedrilled on the drilling and spacing unit drilled and completedin the common sources of supply named in this Application .PROVIDED, however, that any excess royalty, overridingroyalty, or other payments out of production shall be chargedagainst the overriding or excess royalty, or overridingroyalty, as hereinabove set forth, and same shall be reducedby the amount of any such excess .3 . That any owner of the right to drill on said drilling andspacing unit who has not agreed with the Operator to develop said"pooling unit" and common sources of supply is accorded the followingelections as to all or any part of such owner's interests as to eachelection :a .To participate in the development of the unit and commo nsources of supply by agreeing to pay such owner ' sproportionate part of the actual cost of the unit wellcovered hereby and paying , as set out herein , toOperator , OEX- 1 , L . L . C ., such owner's proportionate par tof the estimated completed cost of the producing well

NORTH FORK EXPLORATION, LLCCAUSE CD NO . 200805576-TPAGE 4and the disposal well, as set out in paragraph 2a above,or by securing or furnishing security for such paymentsatisfactory to the Operator, OEX-1, L .L .C ., so as toassure timely payment of such cost ; in all events suchowner's cost in said unit well shall not exceed itsproportionate part of the actual or the reasonable costthereof which shall be determined by the Commission inthe event there is a dispute as to such costs ; thepayment of such owner's proportionate part of theestimated completed for production costs of said unitwell, or the securing of such costs, or the furnishingof security therefore, as aforesaid, shall beaccomplished within 20 days from the date of this Order ,such owner's proportionate part of the costs of, and ofthe production from such unit well, to be in proportionto the number of acres such owner has in the unit ; or ,b .To receive the cash bonus as set out in paragraph 2b or2c above , which shall be paid or tendered , if same canbe paid or tendered , within 35 days from the date o fthis Order , or, if any payment of bonuses due and owin gunder the order cannot be made to any such part yentitled to such payment, then said bonuses, and an yroyalty payments due such party, shall be paid into a nescrow or trust account and shall not be commingled wit hany funds of the Operator . Such funds deposited in sai descrow or trust account shall be held for the exclusiveuse of, and sole benefit of, the party or partie sentitled thereto .If any payment of bonus due and owing under this ordercannot be made because the person entitled theretocannot be located or is unknown, then said bonus shallbe paid into an escrow account within ninety (90) daysafter this order and shall not be commingled with anyfunds of the Operator . Any royalty payments or otherpayments due to such person shall be paid into an escrowaccount by the holder of such funds . Responsibility forfiling reports with the Commission as required by lawand the Commission rule as to bonus, royalty or otherpayments deposited into escrow accounts shall be withthe applicable holder . Such funds deposited in saidescrow accounts shall be held for the exclusive use of,and sole benefit of, the person entitled thereto . Itshall be the responsibility of the Operator to notifyall other holders of this provision and of theCommission rules regarding unclaimed monies underpooling orders .(See attached Exhibit "A" for list of Respondents) .4 . That each owner of the right to drill in said drilling andspacing unit to said common sources of supply covered hereby, who has notagreed to develop said unit, other than the Operator, shall elect as toall or any part of the interest of such owner in the unit which of theelections set out in Paragraph 3 above such owner accepts, said electionto be made to OEX - 1 , L . L . C ., in writing , within 15 days from the date ofthis Order ; in the event any owner fails to elect within the time and inthe manner as set out above which of the alternatives set forth inparagraph 3 above, any such owner accepts, then such owner is deemed tohave elected to receive the cash bonus as set out in paragraph 2b above ;unless the owner is subject to any royalty, overriding royalty, or otherpayments out of production which create a burden on such interest inexcess of the burdens set out in paragraph 2b above, the owner of anysuch interest shall not be entitled to the option provided in paragraph2b above, but shall be required to accept the additional royalty providedin paragraph 2c above . In the event any owner elects to do other thanparticipate in said unit well by paying his pro rata share of the coststhereof, or fails to make any election provided above, such owner shallbe deemed to have relinquished unto Operator all of such owner's right,

NORTH FORK EXPLORATION, LLCCAUSE CD NO . 200805576-TPAGE 5title, interest, or claim in said unit well or wells if hereinafter authorizedto be drilled on the drilling and spacing unit, except for anynormal 1/8 royalty interest, defined above, and other share in productionto which such owner may be entitled by reason of an election hereunder .5 . That Operator, in addition to any other rights providedherein, shall have a lien, as set out in 52 O .S ., Section 87 .1(e), on theinterest of any owner, subject to this Order, who has elected toparticipate in the unit well covered hereby by paying such owner'sproportionate part of the costs thereof ; provided, however, that in theevent an owner elects to participate in said unit well by paying hisproportionate part of the costs thereof and fails or refuses to pay orto secure the payment of such owner's proportionate part of the completedfor production cost as set out in paragraph 2a above, or fails or refusesto pay or make an arrangement with the Operator for the payment thereof,all within the periods of time as prescribed in this Order, then suchowner is deemed to have elected to receive the cash bonus as set out inparagraph 2b above ; unless the owner is subject to any royalty,overriding royalty, or other payments out of production which create aburden on such interest in excess of the burdens set out in paragraph 2babove, the owner of any such interest shall not be entitled to the optionprovided in paragraph 2b above, but shall be required to accept theadditional royalty provided in paragraph 2c above . Thereupon, thepayment of such cash bonus shall be made by Operator within 35 days afterthe last day on which such defaulting owner, under this Order, shouldhave paid his proportionate part of such costs or should have madesatisfactory arrangements for the payment thereof .6 . That OEX-1 , L . L . C . , 4870 South Lewis Avenue, Suite 240,Tulsa , Oklahoma 74105-5153 is designated Operator of the unitpooling and the common sources of supply covered hereby and allelections must be communicated to said Operator at the addressabove as required in this Order . That Operator, OEX-l, L .L .C ., hasthe proper surety and plugging bond on file .7 . That Operator must commence operations for the drilling of theunit well within one year from the date of this Order and diligentlyprosecute the same to completion in a reasonably prudent manner, or thisOrder shall be of no force and effect, except as to the payment of thecash consideration reflected in paragraph 2b or 2c above .8 . Participation in Subsequent Wells : If, subsequent to thedrilling of the initial unit well provided for herein, another well isproposed in the drilling and spacing units covered hereby under the planof development established by this Order, Operator shall send writtennotice of the proposed subsequent well to each party who timely andproperly elected to participate, and who perfected their election to soparticipate, in the development of the separate common sources of supplyin the drilling and spacing units involved in this cause under the planof development . The written notice shall be sent by certified mail tothe last known address of each respondent and shall contain a briefdescription of the proposed subsequent well . The notice shall alsoinclude the estimated costs of the well as a dry hole and as a producingwell . Each party entitled to the above-described written notice shallhave 15 days from date of the notice in which to elect , in writing, tothe operator whether or not to continue to participate in the developmentof the separate common sources of supply and the drilling and spacingunits involved in this cause under the plan of development establishedby this Order as to the proposed subsequent well or in lieu thereof, toelect provision provided for in Paragraph 2b or 2c as defined above forcompensation in full for all rights and interest of such owner in theunit covered hereby . The cash bonus elected to be paid or tenderedwithin 35 days from date of notice .In the event any party who is entitled to make a written electionas to a subsequent well as provided for herein, shall fail to timely andproperly to elect in writing to so participate, or who shall have electedaffirmatively in writing not to participate in such subsequent well andfurther development, then such owner shall be deemed to have relinquished

NORTH FORK EXPLORATION , LLCCAUSE CD NO . 200805576-TPAGE 6unto Operator all of such owner's right, title, interest or claim in andto the unit and separate common sources of supply involved herein as tosuch proposed subsequent well and any further subsequent well or wellsthat may thereafter be proposed and drilled under the plan of developmentexcept for such party's share of the cash bonus and overriding or excessroyalty set forth in Paragraph 2b or 2c above .Any party entitled to make a written election as to a subsequentwell who elects to continue to participate in the development of theseparate common sources of supply in the drilling and spacing unitsprovided for herein under the plan of development established by thisOrder, shall be deemed to have agreed to pay such party's proportionatepart of the actual costs of the proposed subsequent well, and shall paysuch party's proportionate part of the anticipated completed forproduction costs as set forth in the notice within 20 days from date ofnotice thereof , said payment to be made to Operator at its then currentaddress . Upon such timely payment, or the furnishing of security thereofsatisfactory to the Operator, such parties election to continue toparticipate in the development of the drilling and spacing units andcommon sources of supply as to such subsequent well and future wellsshall be perfected . In the event any owner elects as to the proposedsubsequent well to continue to participate in the development of theseparate common sources of supply under the plan of developmentestablished by this Order, but thereafter fails or refuses to pay orsecure the payment of such owner's proportionate part of the estimatedcompleted for production well costs within the manner and time prescribedherein, then such owner shall be deemed to have withdrawn its electionto continue to so participate and such owner, as to the proposedsubsequent well and any further subsequent well or wells under the planof development shall be deemed to have elected in accordance toprovisions as set forth herein .As to any subsequent well proposed under this paragraph, Operatorshall commence, or cause to be commenced, operations on the subsequentwell within 180 days from the date of written notice proposing thesubsequent well, and shall thereafter continue such operations with duediligence to completion . If operations on the proposed subsequent wellare not commenced within the above described 180 day period, then theelections of the parties as to the proposed subsequent well shall expireand the parties shall be in the same position relative to each other thatthey were in immediately prior to the written notice of the subsequentwell being transmitted by Operator . In such event all rights acquiredfrom the parties electing in the proposed subsequent well not to continueto participate in the development of the separate common sources ofsupply and drilling and spacing units under the plan of developmentestablished by this Order, shall be relinquished by Operator and anyother acquiring party and such relinquished rights shall revest in theparties who elected not to continue to so participate . Failure to timelycommence any subsequent well shall not divest or otherwise affect in anymanner the rights and interests of the various parties in any well orwells drilled prior thereto under the plan of development established bythis Order and shall not terminate such plan of development .The term subsequent well for purposes of this paragraph shall notbe deemed to include any side-tracking or other operation with respectto the initial unit well and shall not be deemed to be any well that isdrilled as a replacement or substitute well for the initial unit well orany subsequent well covered hereby, by virtue of any mechanical or otherproblems arising directly in connection with the drilling, completing,equipping or producing of the initial unit well or any subsequent well,and no party subject to this Order shall have the right to make anysubsequent elections as to any such side-tracking, replacement, orsubstitute well .
