4. Scoping part 3 - Guidance for the SEA to be carried out4.1 SEA in RwandaSEA is obligatory under Rwandan law 31 : “any programme, plan and policy that may affect theenvironment must be subjected to environmental assessment”. This obviously applies to a watersector (support) programme, to the development of a master plan for water resourcesmanagement, as well as to plans at catchment level, but to the NCEA’s knowledge SEA has notbeen planned for by the water department.EKN’s choice to use SEA to better define its potential role in the implementation of IWRM inRwanda provides the opportunity to show the value of SEA for planning processes. To apply SEA tosuch a donor support programme rather than a government’s own plan, policy or programme(PPP) does not happen very regularly, but is in fact consistent with not only internationalstandards 32 but also with Rwanda’s own intentions. Recently, in June 2011, general SEAguidelines 33 have been published by REMA. These guidelines do not yet contain clear proceduralarrangements on roles and responsibilities for SEA but they do envisage SEA requirements fordevelopment finance organisations. To provide more clarity on ways forward in this specific case for IWRM support programmedevelopment, this advice will include an SEA format design. The NCEA sees this SEA as an opportunity for EKN but also RWRD and REMA to gain experience inSEA application to different levels of planning, allowing for procedures to be further defined forRwandan SEA practice in general (“learning by doing”).4.2 SEA process and designThe future EKN’s water-sector support programme envisagesParallelIntegratedSEA = planstrengthening the implementation of IWRM in Rwanda. Thetwo are therefore strongly interlinked. An SEA for thedevelopment of EKN’s support programme will therefore alsoneed to look into elements of Rwanda’s own IWRM policy andprogramme, as these elements will inform the correspondingcomponents of the EKN’s support programme.planprocessSEAplanprocessSEA step 1SEA step 2etc……planprocessSEA31 Rwanda’s Organic Law on the Environment (N04/2005) in Ch4, art 6732 DAC Guidelines and Reference Series: Applying Strategic Environmental Assessment; good practice guidance for developmentcooperation, OECD-DAC, 200633 General Guidelines and Procedures for Strategic Environmental Assessment, REMA, June 201123
