That at some time during the month <strong>of</strong> March, 1951, withoutnotice <strong>of</strong> any kind to your petitioner, construction on PRICE street Hascarried on in the manner vlhich caused the original complaint <strong>of</strong> yourpetitioner; and that such construction was carried on in DIRF:CT CCNTR­DICTICN <strong>of</strong> the promise and assurance ~iven by the <strong>City</strong> Engineer to theagents <strong>of</strong> your petitioner as set out in the preceding paragraph.10. That as a result <strong>of</strong> this construction a curb and gutter vlaSlaid by the city <strong>of</strong> <strong>Oxford</strong> around the entire northern and eastern lines<strong>of</strong> the said lot no. 64, thereby completely destroying any frontage <strong>of</strong>lot no. 64 on N. Lamar street. And that not less than eighteen feet <strong>of</strong>previously laid curb and gutter on N. Lamar street was removed anddestroyed as a part <strong>of</strong> this same construction.11.
