That as a result of that conference, the vlife and the brother-in-lawof your petitioner were assured that the plRns of construction of the street,wuld be changed to alleviate the matter by bringing TRICE street into N~Lamar street at more or less a right angle ",hich would leave lot No. 64 Hithseme frontage on N. L':lmar street. This asurance and promise was given tothe agents of your netitioner by the City Engineer in the presence of theMayor and tha.t your petitiorie;-, relying on such assurance'and prblnise,saidnor did nothing more about the matter.9. That at some time during the month of March, 1951, withoutnotice of any kind to your petitioner, construction on PRICE street Hascarried on in the manner vlhich caused the original complaint of yourpetitioner; and that such construction was carried on in DIRF:CT CCNTR­DICTICN of the promise and assurance ~iven by the City Engineer to theagents of your petitioner as set out in the preceding paragraph.10. That as a result of this construction a curb and gutter vlaSlaid by the city of Oxford around the entire northern and eastern linesof the said lot no. 64, thereby completely destroying any frontage oflot no. 64 on N. Lamar street. And that not less than eighteen feet ofpreviously laid curb and gutter on N. Lamar street was removed anddestroyed as a part of this same construction.11. That as a result of the act of the city and in violation of apromise previously ~~~e to your petitioner, your petitioner has been1ITongfully damaged by the city ",i thout nctice and that vJhether or notyour petitioner has or had legal grounds sufficient to support a legalclaim on the city, the city Has morally obligated to support the rromiseand assurance of one of its responsible officers and agents or, if notthat, was moral1y obligated to serve your petitioner ',lith sufficient noticeof its intention to vj olpte its promise that your petitioner ,,,ould havebren able to take appropriate action prior to the completion of the actoomplained of herein.\12.
