ti26MINUTE BOOK No. <strong>14</strong>, CITY OF OXFORD----.~-~DEMENT - MERIOIANWhereas, a majority <strong>of</strong> property owners OwniClg I'lore than fiftyper cent <strong>of</strong> the front footage <strong>of</strong> the property involved in each <strong>of</strong>the respective projected special ~improvements listed in Section 1<strong>of</strong> this resolution, and actually residing on property owned by thenand included within that part <strong>of</strong> any street or avenue herein embracedordered to be improved, or otherwise actually accupying propertyowned by them and included within the respective projectedspecial improvements listed in Section 1 <strong>of</strong> this resolution, havenot appeared in person, by attorney, or by instrument <strong>of</strong> vn'itingto protest said respective improvements, as provided by law theymay do; and,Whereas, the Hayor and Board <strong>of</strong> ,'\ldermen <strong>of</strong> The <strong>City</strong> <strong>of</strong> <strong>Oxford</strong>,Mississippi, sitting to hear objections, prot.ests and remonstrances,in any there be, against said special improvements, adjudges thatno successful objections have been made and he~rd; and,Whereas, this Governing Authority adjudges that said specialimprovements be '11ade as provided in said resolutions, in so far asthe streets and avenues designated in Sectinn 1 <strong>of</strong> this resolutionare concerned, declaring necessary, and that the property ownerswhose property abuts on the several streets and avenues in thespecified areas enumerated in Section 1 <strong>of</strong> this resolution shallpay the costs and expenses 0f constructing the curbs, gutters,storm sewers, incidental drains, wa ter and se\-1er connections, fl.ndone-third <strong>of</strong> the costs and expenses on each side <strong>of</strong> said streetsand avenues <strong>of</strong> street grading, graveling and paving, computed,assessed and collected in the manner prov~r1~d b:" House Bill No. 76<strong>of</strong> the ~cts <strong>of</strong> the Regular Legislative Session <strong>of</strong> the ItlssissippiLegislature in <strong>1950</strong>;Now, therefore;Section 2. Be it ordained by the l~yor and Board <strong>of</strong> Aldermen<strong>of</strong> The <strong>City</strong> <strong>of</strong> <strong>Oxford</strong>, Mississippi, that the <strong>City</strong> Engineer be andhe is hereby authorized to construct, or cause to be constructed,paving, curbs, gutters, sidewaL~s and pavement thereon; to laylead or other water pipes, sanitary and storm sewers; and do suchgrading, grave1in", drainage, and other things and acts as may benecessary and incident to the improvements specified on the respectivestreets and avenues enumerated in paragraphs (a), (b),(b-2), (c), (d) and (e) <strong>of</strong> Section 1 <strong>of</strong> this resolution.Be it further ordained by the ~yor and Board <strong>of</strong> Aldermen <strong>of</strong>THE CITY OF OXFORD, l-.ITSSISSIPPI, that the Cit~T Engineer shall keepan accurate account <strong>of</strong> said improvements and make a report <strong>of</strong> thesame to the said l~yor and Board <strong>of</strong> Aldermen in the manner andform provided by Im-1.Section 3. Be it further ordained by the l~yor and 30ard <strong>of</strong>Aldermen <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oxford</strong>, Mississippi that the <strong>City</strong> Engineerbe and he is hereby required to keep an account <strong>of</strong> the costs <strong>of</strong>said special improvements in the form and manner required ~J law,and to make a report to this Governing Body in order that saidGoverning Authority may levy the special assessments against theabutting property owners on the basis above specified and in themanner set forth by the Im.s <strong>of</strong> the State <strong>of</strong> Mississippi.Section 4. Be it further ordained by the Mayor and Board <strong>of</strong>Aldermen <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oxford</strong>, Mississippi that this resolutiontake effect and be in force as provided by law.Alderman H. S. Sisk moved the adoption <strong>of</strong> the resolutionend Alderman T. E. Combs seconded the motion.Alderman A. H. Avent voted Yea; Alderman H. T. Chandlervoted yea; Alderman T. E. Combs voted yea; Alderman Ben J. Hilbunvoted; and Alderman II. 8. Sisk voted yea.The motion having ~eceived the affirnative vote <strong>of</strong> all members<strong>of</strong> the Board <strong>of</strong> Aldermen present, the ~yor declared themotion passed and the resolution adopted.This reso1uticn is this, the 7th day <strong>of</strong> November, <strong>1950</strong>, approved.(8 E A L )Attest:
