That in grading, laying water, sanitary and stormsewer lines, drainage, street paving, constructing curbs, guttersand sidewalks, and extending and widening streets and avenues saidimprovements require unusual outley for which the General ImprovementFund is not sufficient and for which the General ImprovementFund should not be used.Section 3. Be it further resolved that the plans and specificationsprepared by the <strong>City</strong> Engineer and now on file in the <strong>City</strong>Engineer's <strong>of</strong>fice providing for the construction <strong>of</strong> the above mentionedstreet pavement and improvements enumerated in Section 1 and2 <strong>of</strong> this resolution be and the same are hereby approved and adopted.Section 4. That the grades specified in the plans and specificationsmentioned in Section 3 <strong>of</strong> this resolution are hereby adoptedand established as to the grades on which said pavement, curbs, guttersand other works and improvements herein enumerated and referred to areto be constructed.Section 5. That the property owners whose property abuts on theseveral streets and avenues enumerated in Section 1 <strong>of</strong> this resolutionshall pay the costs and expenses <strong>of</strong> constructing the curbs, gutters,storm sewers, incidental drains, water and sewer connections,91done-third <strong>of</strong> the costs and expenses (one-third on each side <strong>of</strong> thestreets and avenues) <strong>of</strong> abutting street grading, graveling and paving,computed in the manner provided by Section 5 <strong>of</strong> House Bill No. 76 <strong>of</strong>the Acts <strong>of</strong> the Regular Legislative Session <strong>of</strong> <strong>1950</strong>, or be subjectto assessment <strong>of</strong> said costs and expenses as provided by Section 7<strong>of</strong> House Bill No. 76 <strong>of</strong> the Aets <strong>of</strong> the Regular Legislative Session<strong>of</strong> <strong>1950</strong>. ' 'Section 6. That the materials with which said streets and avenuesand other works are to be constructed and/or paved and speciallyimproved shall be any <strong>of</strong> that which is set forth in the plans andspecifications prepared by the <strong>City</strong> Engineer which have been adoptedand are now on file with the <strong>City</strong> Engineer.Section 7. That the <strong>City</strong> Clerk shall publish this resolutionas required by law, once each week for three successive pUblicationsin the <strong>Oxford</strong> Eagle, a public newspaper having a general circulationin <strong>Oxford</strong>, MiSSissippi, and any person aggrieved may appear in person,by attorney or by petition and make or file a protest against theconstruction <strong>of</strong> said improvements within fifteen days after the firstpublication <strong>of</strong> this resolution.Section 8. That a copy <strong>of</strong> this resolution be spread upon theminutes <strong>of</strong> this meeting, and that the 7th day <strong>of</strong> November, <strong>1950</strong>, at7 .' clock P. M., in the regular meeting room <strong>of</strong> this governing body,be fixed as the date, time and place for the meeting <strong>of</strong> this body tohear objections and remonstrances that may be made to said improvements;notice being hereby specifically given that petitions may befiled with the <strong>City</strong> Clerk at the <strong>City</strong> Hall in <strong>Oxford</strong>, Mississippi,or that petitions may be filed and appearances made, either in personor by attorney, with the Mayor and Board <strong>of</strong> Aldermen at the <strong>City</strong>H all in <strong>Oxford</strong>, Mississippi at the time and place herein above setforthSection 9. That this resolution take effect and be in force asprovided by law.Adlerman T. E, Combs moved the adoption <strong>of</strong> the resolution andAlderman H. S. Sisk seconded the motion.
