5. DEFINING A FRAMEWORK FORUK SUCCESSE-commerce@its.best.uk24Summary5.1 This chapter sets out the PIU Team’sview that success in e-commerce is a sharedenterprise between Government andindustry. A consistent message from industryhas been that Government should notintervene unnecessarily in developinge-commerce markets. Supporting this view,the chapter sets out the parameters of a rolefor Government and proposes a new form ofco-operative regulation, or ‘co-regulation’,between Government and industry.5.2 The chapter then goes on to define thestructure that has been used to analyse thebarriers to achieving e-commerce success inthe UK.The Respective Roles ofGovernment and theMarket5.3 The PIU Team strongly believes thatmuch of the action needed to drive forwarde-commerce in the UK will rest with industry,backed by Government support. Governmentand industry both have their part to play, buta market-led approach to e-commerce isessential if innovation, creativity andentrepreneurship are not to be stifled. Therole of Government, as illustrated in figure5.1, should therefore be restricted to:providing a light-touch regulatory andtax framework within which electronicmarkets can operate;acting as a catalyst for change, bytackling market inefficiencies (see Appendixfour for further details), but also byworking pro-actively to raise awareness ofe-commerce threats and opportunities andto ensure a supply of skilled people;ensuring that e-commerce developmentscontribute to the creation of a strongand fair society, by acting to address theequity and social inclusion issues raised bye-commerce, irrespective of the efficiencyor otherwise of market processes; andacting as an exemplar in its own useof e-commerce technologies in servicedelivery and procurement – both toincrease Government’s own efficiencyand effectiveness and to raise skills andexpectations among consumers andbusinesses.Co-regulation5.4 Consistent with the view that evencloser co-operation between Government andindustry is required, the PIU Team proposesthat new co-operative methods of achievingpolicy objectives will be needed. Therefore,a key theme throughout this report is theapproach known as ‘co-regulation’.5.5 Co-regulation recognises that alaissez-faire approach to the Internet byGovernments is not tenable in an era ofmass-market e-commerce. Consumers needconfidence that the transactions they makeelectronically will be secure, that the goodsthey order will turn up, and so on. Businessesneed to know that on-line transactions willbe honoured and need to understand theirliability in an on-line world. Originators ofcontent need to know that they will beproperly remunerated. To give consumersand business this trust and thus to facilitatethe growth of e-business, an underpinninglegal and regulatory framework is essential.
