11. SPECIAL PROCEDURE IN CERTAIN CASES:Notwithstanding anything contained in rules 8, 9 and 10-(1) where a penalty is imposed on a Subordinate Police Officer on theground of conduct which has led to his conviction on a criminalcharge; or(2) where the Disciplinary Authority is satisfied for reasons to berecorded in writing that it is not reasonably practicable to follow theprocedure prescribed in these rules or(3) where the President is satisfied that in the interest of the security ofthe State it is not expedient to follow such procedure, the DisciplinaryAuthority may consider the circumstances of the case and pass suchorders thereon as it deems fit.12. PROVISION REGARDING OFFICERS LENT TO STATE GOVT. ETC.(1) Where the services of a Subordinate Police Officer are lent to anyother Department of the Central Government or to a StateGovernment or Union Territory or to a local or other authority(hereinafter in this rule referred to as "the borrowing authority") theborrowing authority shall have the powers of the Appointing Authorityfor the purpose of placing him under suspension and of theDisciplinary Authority for the purpose of taking disciplinaryproceedings against him;Provided that the borrowing authority shall forthwith informthe authority which lent his services (hereinafter in this rule referredto as "the lending authority") of the circumstances leading to the orderof his suspension or the commencement of the disciplinary proceedingas the case may be, except in respect of proceedings under rule 9.(2) In the light of the findings in the disciplinary proceedings takenagainst the Subordinate Police Officer,(i) if the borrowing authority is of the opinion that any ofthe penalties specified in clauses (i) to (vi) of rule 6 should beimposed on him, it may pass such order on the case as itdeems necessary;(ii) if the borrowing authority is of the opinion that any ofthe penalties specified in clauses (vii) to (x) of rule 6 should beimposed on him, it shall replace his services at the disposal ofPage 355 of 355
