(9) The Disciplinary Authority shall, if it is not the Inquiring Authorityconsider the record of the inquiry and record its findings on eachcharge.(10) (i) If the Disciplinary Authority, having regard to its findings onthe charges, is of the opinion that any of the penalties specified inclauses (vii) to (x) of rule 6 should be imposed, it shall(a) furnish to the Subordinate Police Officer a copy of thereport of the Inquiring Authority and, where the DisciplinaryAuthority is not the Inquiring Authority, a statement of itsfindings together with brief reasons for disagreement if any,with the findings of the Inquiring Authority; and(b) give him a notice stating the action proposed to be takenin regard to him and calling upon him to submit within aspecified time such representation as he may wish to makeagainst the proposed action.(ii) The Disciplinary Authority shall consider the representation, ifany, made by the Subordinate Police Officer in response to the noticeunder clause (i) and determine what penalty, if any, should beimposed on the Subordinate Police Officer and pass appropriateorders on the case.(11) If the Disciplinary Authority having regard to its findings, is of theopinion that any of the penalties specified in clause (iii) to (vi) of rule 6should be imposed, it shall pass appropriate orders in the case.(12) Orders passed by the Disciplinary Authority shall be communicated tothe Subordinate Police Officer who shall also be supplied with a copyof the report of the Inquiring Authority and, where the DisciplinaryAuthority is not the Inquiring Authority, a statement of its findingstogether with brief reasons for disagreement, if any, with the findingsof the Inquiring Authority, unless they have already been supplied tohim.9. PROCEDURE FOR IMPOSING MINOR PENALTIES(1) In every case where it is proposed to impose on a Subordinate PoliceOfficer any of the penalties mentioned in clause (i) and (ii) of rule 6, heshall be given an opportunity of explaining orally his conduct againstthe action proposed to be taken in regard to him. This explanationand the orders passed will be briefly recorded by the officer imposingthe penalty or penalties in a register maintained for this purpose.Page 353 of 353
