Recommendations: 3.11.1 Authority <strong>to</strong> Set Financial Penalties1. <strong>The</strong> legislation should be changed <strong>to</strong> remove <strong>the</strong> specific amounts <strong>of</strong> financialpenalties.2. <strong>The</strong> legislation should be changed <strong>to</strong> enable <strong>the</strong> Minister, on <strong>the</strong> advice <strong>of</strong> <strong>the</strong> <strong>WCB</strong>Board <strong>of</strong> Direc<strong>to</strong>rs, <strong>to</strong> set <strong>the</strong> level <strong>of</strong> financial penalties by regulation.3. It is suggested <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs review <strong>the</strong> current level <strong>of</strong> financialpenalties with a view <strong>to</strong> bringing <strong>the</strong> amounts <strong>of</strong> financial penalties up-<strong>to</strong>-date andadvise <strong>the</strong> Minister <strong>of</strong> <strong>the</strong> results <strong>of</strong> <strong>the</strong>ir review.3.11.2 Application <strong>of</strong> PenaltiesSome stakeholders <strong>to</strong>ld us that <strong>the</strong>y experienced hardship when those required <strong>to</strong> performan action under <strong>the</strong> <strong>Act</strong>s failed <strong>to</strong> do so. An example given <strong>to</strong> <strong>the</strong> <strong>Panel</strong> was a healthcentre failing <strong>to</strong> report <strong>to</strong> <strong>the</strong> <strong>WCB</strong>.<strong>The</strong> <strong>Act</strong>s are clear that all who fail <strong>to</strong> comply are subject <strong>to</strong> penalty. <strong>The</strong>refore, <strong>the</strong> <strong>Panel</strong>does not see this as a legislative issue. We agree that those named in <strong>the</strong> <strong>Act</strong>s must liveup <strong>to</strong> <strong>the</strong>ir responsibilities. If <strong>the</strong>y do not, <strong>the</strong> <strong>Act</strong>s provide for consequences.3.12 Employer Responsibilities3.12.1 Duty <strong>to</strong> AccommodateAn employer’s duty <strong>to</strong> accommodate a recovered worker is one that has been introducedin<strong>to</strong> <strong>the</strong> legislation <strong>of</strong> 5 o<strong>the</strong>r jurisdictions. Essentially, an employer has a legislated duty<strong>to</strong> re-employ a recovered worker. Whe<strong>the</strong>r <strong>the</strong> worker is re-employed in <strong>the</strong>ir previousjob or in ano<strong>the</strong>r job is dependent on <strong>the</strong> recovered worker’s capability <strong>to</strong> perform <strong>the</strong>work.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 75 <strong>of</strong> 128December, 2001
