Respondents did think that access <strong>to</strong> certain confidentialor privileged matters, such as information about <strong>WCB</strong> personnel and legal advice, shouldbe withheld.Stakeholders said <strong>the</strong>y knew <strong>the</strong>re was access <strong>to</strong> information legislation that applied <strong>to</strong><strong>the</strong> <strong>WCB</strong>. <strong>The</strong>y still thought <strong>the</strong> <strong>Act</strong>s should be changed <strong>to</strong> make it easier <strong>to</strong> accessinformation. <strong>The</strong> <strong>Panel</strong> agrees.Stakeholders also <strong>to</strong>ld <strong>the</strong> <strong>Panel</strong> about difficulties <strong>the</strong>y encountered in gaining access <strong>to</strong><strong>the</strong> information held by <strong>the</strong> <strong>WCB</strong> about <strong>the</strong>m. Whe<strong>the</strong>r this is an operational orlegislative issue is not clear. <strong>The</strong> <strong>Panel</strong> does not see any reason why a worker oremployer, or <strong>the</strong>ir authorized representative, should not have access <strong>to</strong> all <strong>the</strong> information<strong>the</strong> <strong>WCB</strong> holds about <strong>the</strong>m.Recommendations: 3.10.1 Access <strong>to</strong> <strong>WCB</strong> Documents1. <strong>The</strong> legislation should be changed <strong>to</strong> enable access <strong>to</strong> <strong>WCB</strong> documents, with <strong>the</strong>exception <strong>of</strong> worker and employer files, information now protected in <strong>the</strong> <strong>Act</strong>s,information concerning personnel, and o<strong>the</strong>r confidential or privileged informationlike legal advice.2. <strong>The</strong> legislation should be reviewed <strong>to</strong> confirm <strong>the</strong>re are no impediments <strong>to</strong> access bya worker or employer, or <strong>the</strong>ir authorized representative, <strong>to</strong> information about <strong>the</strong>m orany dealings <strong>the</strong>y are engaged in with <strong>the</strong> <strong>WCB</strong>.3.10.2 Access <strong>to</strong> <strong>Review</strong> Committee and Appeals Tribunal <strong>Report</strong>sA number <strong>of</strong> stakeholders <strong>to</strong>ld <strong>the</strong> <strong>Panel</strong> that <strong>the</strong>y wished <strong>to</strong> have access <strong>to</strong> reports <strong>of</strong><strong>Review</strong> Committees or <strong>the</strong> Appeals Tribunal. <strong>The</strong>y indicated that it would help o<strong>the</strong>rstakeholders preparing for reviews or appeals <strong>to</strong> know what had been decided in similarcases.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 73 <strong>of</strong> 128December, 2001
