<strong>The</strong> <strong>Panel</strong> has recommended changing <strong>the</strong> basis for <strong>the</strong> compensation system in Section3.6.2, System <strong>of</strong> Financial Compensation. <strong>The</strong> <strong>Panel</strong> recommends that <strong>the</strong>re continue <strong>to</strong>be some financial compensation <strong>to</strong> recognize <strong>the</strong> effects <strong>of</strong> a permanent impairment ordisability.In those jurisdictions that also provide financial compensation for permanent disability orimpairment, this financial compensation is generally commuted.Recommendation: 3.6.8 Commutations1. <strong>The</strong> legislation should be changed <strong>to</strong> commute or pay a lump sum for financialcompensation for permanent partial or <strong>to</strong>tal impairment or disability compensation on<strong>the</strong> request <strong>of</strong> an injured worker. See also Recommendation #2, 3.6.2, System <strong>of</strong>Financial Compensation.3.6.9 Guardianship<strong>The</strong> <strong>Panel</strong> was asked <strong>to</strong> consider <strong>the</strong> interpretation <strong>of</strong> <strong>the</strong> legislation related <strong>to</strong> <strong>the</strong>payment <strong>of</strong> allowances <strong>to</strong> guardians, who are <strong>the</strong> natural parents <strong>of</strong> dependant children.<strong>The</strong> <strong>Panel</strong> was <strong>to</strong>ld that <strong>the</strong> current interpretation prohibited such payments.<strong>The</strong> <strong>Panel</strong> has since been advised that <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs has amended <strong>the</strong>irpolicy <strong>to</strong> permit <strong>the</strong> payment <strong>of</strong> guardianship allowances <strong>to</strong> <strong>the</strong> natural parents <strong>of</strong>dependent children. As a consequence, this is no longer an issue.3.6.10 Medical Compensation<strong>The</strong> <strong>Panel</strong> heard from a number <strong>of</strong> stakeholders about <strong>the</strong> process for choosing <strong>the</strong>supplier <strong>of</strong> medical compensation, particularly as it relates <strong>to</strong> treatment facilities. <strong>The</strong><strong>Act</strong>s generally state that it is <strong>the</strong> <strong>WCB</strong> that makes <strong>the</strong> determination about whichtreatment facilities will be used. From an operational standpoint, <strong>the</strong> <strong>WCB</strong> may haveentered in<strong>to</strong> contracts for treatment or may have a list <strong>of</strong> specialists in a particular field.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 61 <strong>of</strong> 128December, 2001
