<strong>The</strong> <strong>Act</strong>s are very specific in some instances – for example, pay an allowance up <strong>to</strong> $100a year <strong>to</strong> replace clothing damaged by a pros<strong>the</strong>sis or appliance. In o<strong>the</strong>rs <strong>the</strong> legislationis very general – for example, make expenditures <strong>to</strong> assist in lessening any handicapresulting from a work-related injury.Stakeholders urged <strong>the</strong> <strong>Panel</strong> <strong>to</strong> recommend increases <strong>to</strong> <strong>the</strong> amount <strong>of</strong> compensation in<strong>the</strong>se special purpose areas. <strong>The</strong>y also urged <strong>the</strong> <strong>Panel</strong> <strong>to</strong> recommend <strong>the</strong> application <strong>of</strong>common sense and compassion in <strong>the</strong> interpretation <strong>of</strong> legislation or policy. Manystakeholders said <strong>the</strong>y thought entitlements should be spelled out in legislation so <strong>the</strong>ydid not have <strong>to</strong> go begging for compensation <strong>to</strong> pay for items such as cushions forwheelchairs.O<strong>the</strong>r jurisdictions also provide for special purpose compensation. <strong>The</strong> basis forcalculation varies. <strong>The</strong> authority for setting <strong>the</strong> type and amount <strong>of</strong> special purposecompensation also varies. Some jurisdictions include certain compensation in legislation,o<strong>the</strong>rs in regulation, and o<strong>the</strong>rs in policy.<strong>The</strong> majority <strong>of</strong> respondents <strong>to</strong> <strong>the</strong> Stakeholder Questionnaire thought <strong>the</strong> allowance forclothing should be increased and <strong>the</strong> interpretation widened <strong>to</strong> include damage from o<strong>the</strong>rmedical equipment, such as wheelchairs.<strong>The</strong> <strong>Panel</strong> has said that it prefers <strong>to</strong> see legislation providing a framework for workers’compensation. <strong>The</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs should <strong>the</strong>n establish policies within thatframework <strong>to</strong> implement <strong>the</strong> legislation in a manner that is directed <strong>to</strong>ward <strong>the</strong> legislativepurpose. In keeping with that position, <strong>the</strong> <strong>Panel</strong> believes that <strong>the</strong> details <strong>of</strong> specialpurpose compensation for things like clothing allowances, funeral expenses, and quality<strong>of</strong> life should be removed from legislation and established in policy.<strong>The</strong> <strong>Panel</strong> urges <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs <strong>to</strong> carefully review <strong>the</strong> type and amount <strong>of</strong>financial compensation for <strong>the</strong>se purposes with a view <strong>to</strong> increasing compensation. <strong>The</strong><strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 56 <strong>of</strong> 128December, 2001
