<strong>The</strong> <strong>Panel</strong> considered <strong>the</strong> establishment <strong>of</strong> <strong>the</strong> 2 Appeals Tribunals, one for <strong>the</strong> NWT andone for Nunavut. Respondents <strong>to</strong> <strong>the</strong> Stakeholder Questionnaire were almost evenlysplit. We concluded that this is a matter for <strong>the</strong> terri<strong>to</strong>rial governments <strong>to</strong> consider in<strong>the</strong>ir interjurisdictional agreement.<strong>The</strong> <strong>Panel</strong> considered <strong>the</strong> length <strong>of</strong> appointment for members <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong>Direc<strong>to</strong>rs in Section 3.3.6, <strong>WCB</strong> Board Members’ Term <strong>of</strong> Office and believes <strong>the</strong> sameapproach should apply <strong>to</strong> <strong>the</strong> Appeals Tribunal.Recommendations: 3.5.4 Appointments <strong>to</strong> <strong>the</strong> Appeals Tribunal1. <strong>The</strong> legislation should be changed <strong>to</strong> require advice from <strong>the</strong> Nunavut Minister on allAppeals Tribunal appointments.2. <strong>The</strong> legislation should be changed <strong>to</strong> appoint members <strong>of</strong> <strong>the</strong> Appeals Tribunal for aterm up <strong>to</strong> 3 years. <strong>The</strong> <strong>Panel</strong> urges <strong>the</strong> Minister <strong>to</strong> consider staggered terms <strong>to</strong>provide continuity and stability on <strong>the</strong> Appeals Tribunal.3. <strong>The</strong> legislation should be changed <strong>to</strong> enable <strong>the</strong> reappointment <strong>of</strong> members <strong>of</strong> <strong>the</strong>Appeals Tribunal <strong>to</strong> a maximum <strong>of</strong> 6 consecutive years <strong>of</strong> service. Former membersmay be reappointed <strong>to</strong> <strong>the</strong> Appeals Tribunal after a 1 year break in service.4. <strong>The</strong> current provision in <strong>the</strong> <strong>Act</strong>s <strong>to</strong> enable a member <strong>of</strong> <strong>the</strong> Appeals Tribunal <strong>to</strong>complete <strong>the</strong>ir duties if an appeal has started but not finished before <strong>the</strong> expiry <strong>of</strong><strong>the</strong>ir term should remain.3.5.5 Time Limits in <strong>the</strong> Appeal ProcessesStakeholders and respondents <strong>to</strong> <strong>the</strong> Stakeholder Questionnaire <strong>to</strong>ld <strong>the</strong> <strong>Panel</strong> about <strong>the</strong>hardship created by <strong>the</strong> length <strong>of</strong> time <strong>the</strong> appeal processes take. <strong>The</strong>y <strong>to</strong>ld <strong>the</strong> <strong>Panel</strong> thatreasonable time limits should mark <strong>the</strong> steps in <strong>the</strong> appeals. <strong>The</strong>se steps are:Lodging a review.Holding a review hearing.<strong>Report</strong>ing on <strong>the</strong> decision <strong>of</strong> <strong>the</strong> <strong>Review</strong> Committee.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 44 <strong>of</strong> 128December, 2001
