Recommendations: 3.5.1 <strong>Review</strong> Committee1. <strong>The</strong> legislation should be changed <strong>to</strong> define <strong>the</strong> <strong>Review</strong> Committee as an internalcommittee <strong>of</strong> <strong>the</strong> <strong>WCB</strong>, appointed by <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs.2. <strong>The</strong> legislation should be changed <strong>to</strong> include <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> <strong>Review</strong> Committeethat is, upon written submission <strong>of</strong> a worker, dependant, or employer, <strong>to</strong> objectivelyreview <strong>WCB</strong> administration decisions regarding financial, medical, or vocationalrehabilitation compensation and assessment.3. <strong>The</strong> legislation should be changed <strong>to</strong> require <strong>the</strong> <strong>Review</strong> Committee <strong>to</strong> hearrepresentations from appellants who wish <strong>to</strong> make <strong>the</strong>m.4. <strong>The</strong> legislation should be changed <strong>to</strong> apply <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs’ policy whereapplicable.3.5.2 Conflicting Medical Opinion<strong>The</strong> <strong>Panel</strong> heard a great deal about how conflicting medical opinions are handled now,and how <strong>the</strong>y should be handled. Conflicting medical opinions were usually between aninjured worker’s health care provider and <strong>the</strong> <strong>WCB</strong>’s medical advisors.<strong>The</strong> <strong>Act</strong>s enable <strong>the</strong> <strong>Review</strong> Committee <strong>to</strong> call for a medical examination <strong>of</strong> an injuredworker for review purposes. <strong>The</strong> <strong>Act</strong>s do not specifically enable <strong>the</strong> Appeals Tribunal <strong>to</strong>call for a medical examination <strong>of</strong> an injured worker. <strong>The</strong> <strong>Act</strong>s do enable <strong>the</strong> AppealsTribunal <strong>to</strong> establish its own rules <strong>of</strong> practice and procedure. <strong>The</strong> <strong>Act</strong>s do not require <strong>the</strong>involvement <strong>of</strong> <strong>the</strong> injured worker in selecting <strong>the</strong> health care provider or medicalassessment facility for <strong>the</strong>se additional examinations.Many stakeholders <strong>to</strong>ld <strong>the</strong> <strong>Panel</strong> that <strong>the</strong>y thought <strong>the</strong>re should be some means <strong>to</strong>resolve differences <strong>of</strong> medical opinion between treating health care providers, specialis<strong>the</strong>alth care providers, and <strong>the</strong> <strong>WCB</strong> medical advisors. Some stakeholders suggested that<strong>the</strong> <strong>Panel</strong> consider recommending medical resolutions committees for this purpose. <strong>The</strong>yreferred <strong>to</strong> <strong>the</strong> Friedman <strong>Report</strong>, which recommends <strong>the</strong> establishment <strong>of</strong> medical<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 39 <strong>of</strong> 128December, 2001
