eview committees shall conduct “documentary reviews” only and not hearrepresentations from appellants. <strong>The</strong> <strong>Review</strong> Committee may confirm, vary, or reversedecisions <strong>of</strong> <strong>the</strong> <strong>WCB</strong> administration.<strong>The</strong> second step in <strong>the</strong> appeals process is <strong>the</strong> Appeals Tribunal. <strong>The</strong> NWT/NunavutAppeals Tribunal is established in legislation. <strong>The</strong> Appeals Tribunal has exclusivejurisdiction <strong>to</strong> hear appeals from <strong>the</strong> <strong>Review</strong> Committee. It may confirm, reverse, or varya decision <strong>of</strong> <strong>the</strong> <strong>Review</strong> Committee. <strong>The</strong> authority <strong>to</strong> appoint members and <strong>the</strong>composition <strong>of</strong> <strong>the</strong> Tribunal are also described in <strong>the</strong> <strong>Act</strong>s.3.5.1 <strong>Review</strong> CommitteeSome stakeholders have suggested <strong>to</strong> <strong>the</strong> <strong>Panel</strong> that <strong>the</strong> <strong>Review</strong> Committee be eliminatedand replaced with a dispute resolution process similar <strong>to</strong> that recommended in <strong>the</strong> Final<strong>Report</strong> <strong>of</strong> <strong>the</strong> <strong>Review</strong> Committee <strong>of</strong> <strong>the</strong> Workers’ Compensation Board Appeal Systemschaired by Samuel Friedman, QC (<strong>the</strong> Friedman <strong>Report</strong>). This report was completed inNovember 2000. <strong>The</strong> majority <strong>of</strong> respondents <strong>to</strong> <strong>the</strong> Stakeholder Questionnaire did notthink <strong>the</strong> <strong>Review</strong> Committee should be eliminated.All but 2 jurisdictions have some form <strong>of</strong> internal review process as <strong>the</strong> first level <strong>of</strong> <strong>the</strong>appeal process. In <strong>the</strong>se jurisdictions, <strong>the</strong> process for review is not always described indetail in legislation.<strong>The</strong> <strong>Act</strong>s do not describe <strong>the</strong> <strong>Review</strong> Committee per se. Sections 24 and 64 enable aworker, employer, or dependant <strong>to</strong> appeal a decision <strong>to</strong> <strong>the</strong> <strong>Review</strong> Committee. Section24(1) states that <strong>the</strong> <strong>Review</strong> Committee is appointed by <strong>the</strong> Board (whe<strong>the</strong>r <strong>WCB</strong> Board<strong>of</strong> Direc<strong>to</strong>rs or corporate <strong>WCB</strong> is unclear), and with <strong>the</strong> consent <strong>of</strong> <strong>the</strong> Board, hearsrepresentations on behalf <strong>of</strong> <strong>the</strong> appellant. <strong>The</strong> <strong>Act</strong>s state that <strong>the</strong> <strong>Review</strong> Committee willonly review decisions related <strong>to</strong> compensation and assessment.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 37 <strong>of</strong> 128December, 2001
