members may be reappointed <strong>to</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs after a 1 year break inservice.3.3.7 Remuneration <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs<strong>The</strong> <strong>Act</strong>s provide that <strong>the</strong> Minister sets <strong>the</strong> remuneration for members <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board<strong>of</strong> Direc<strong>to</strong>rs, including <strong>the</strong> Chairperson. <strong>The</strong> Minister is not obliged <strong>to</strong> publicly disclosehis decision on remuneration. This lack <strong>of</strong> disclosure was raised as a concern during <strong>the</strong><strong>Panel</strong>’s public hearings.<strong>The</strong> <strong>Panel</strong> agrees <strong>the</strong> Minister should set <strong>the</strong> remuneration for <strong>WCB</strong> Board members. <strong>The</strong>practice in <strong>the</strong> vast majority <strong>of</strong> o<strong>the</strong>r jurisdictions is <strong>to</strong> publicly disclose <strong>the</strong> amount <strong>of</strong>remuneration paid <strong>to</strong> members <strong>of</strong> boards <strong>of</strong> direc<strong>to</strong>rs. Given its concern abouttransparency, <strong>the</strong> <strong>Panel</strong> agrees with <strong>the</strong> approach in o<strong>the</strong>r jurisdictions and <strong>the</strong> advicereceived during <strong>the</strong> public hearings.<strong>The</strong> <strong>Panel</strong> did not see a Vice-Chairperson having any additional role on <strong>the</strong> <strong>WCB</strong> Board<strong>of</strong> Direc<strong>to</strong>rs unless <strong>the</strong>y were acting for <strong>the</strong> Chairperson (Section 3.3.5, Vice-Chairpersonfor <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs). <strong>The</strong>refore, <strong>the</strong> <strong>Panel</strong> does not see a difference in <strong>the</strong>remuneration for <strong>the</strong> position <strong>of</strong> Vice-Chairperson.<strong>The</strong> <strong>Panel</strong> noted that <strong>the</strong> legislation does not require <strong>the</strong> Minister <strong>to</strong> publicly disclose <strong>the</strong>remuneration for members <strong>of</strong> <strong>the</strong> Appeals Tribunal. In keeping with <strong>the</strong> <strong>Panel</strong>’s positionfor public disclosure <strong>of</strong> <strong>the</strong> remuneration paid <strong>to</strong> <strong>the</strong> Chairperson and <strong>WCB</strong> Board <strong>of</strong>Direc<strong>to</strong>rs’ members, <strong>the</strong> <strong>Panel</strong> believes <strong>the</strong> same approach should be applied <strong>to</strong> <strong>the</strong>Appeals Tribunal.Recommendations: 3.3.7 Remuneration <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs1. <strong>The</strong> legislation should be changed <strong>to</strong> require <strong>the</strong> Minister <strong>to</strong> set <strong>the</strong> remuneration formembers <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs, including <strong>the</strong> Chairperson, in regulation.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 32 <strong>of</strong> 128December, 2001
