ones held accountable for a decision <strong>to</strong> appoint <strong>the</strong> chairperson. <strong>The</strong>y should be free <strong>to</strong>seek additional advice from whomever <strong>the</strong>y wish.Recommendation: 3.3.4 Appointment <strong>of</strong> Chairperson1. <strong>The</strong> legislation should be changed <strong>to</strong> require <strong>the</strong> NWT Minister <strong>to</strong> consult with <strong>the</strong>Nunavut Minister before appointing <strong>the</strong> Chairperson <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs.3.3.5 Vice-Chairperson for <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs<strong>The</strong> <strong>Panel</strong> was asked <strong>to</strong> consider a change <strong>to</strong> legislation <strong>to</strong> enable <strong>the</strong> appointment <strong>of</strong> aVice-Chairperson <strong>of</strong> <strong>the</strong> Board <strong>of</strong> Direc<strong>to</strong>rs.<strong>The</strong> legislation in <strong>the</strong> vast majority <strong>of</strong> o<strong>the</strong>r jurisdictions provides for <strong>the</strong> appointment <strong>of</strong>a vice-chairperson. Of <strong>the</strong> 3 that do not, 2 have legislative provisions for <strong>the</strong> appointment<strong>of</strong> an acting chairperson. <strong>The</strong> authority <strong>to</strong> appoint varies among jurisdictions, but isusually <strong>the</strong> Minister, Chairperson, or Board <strong>of</strong> Direc<strong>to</strong>rs.<strong>The</strong> <strong>Panel</strong> sees <strong>the</strong> sense <strong>of</strong> having a vice-chairperson available <strong>to</strong> act when <strong>the</strong>Chairperson is not available. <strong>The</strong> <strong>Panel</strong> does not expect this situation will occur that<strong>of</strong>ten. However, having a designated person available <strong>to</strong> step in for <strong>the</strong> Chairpersonwould remove any operational inconvenience. <strong>The</strong> <strong>Panel</strong> does not see ano<strong>the</strong>r role for<strong>the</strong> Vice-Chairperson.<strong>The</strong> <strong>Panel</strong> is <strong>of</strong> <strong>the</strong> view that <strong>the</strong> Board <strong>of</strong> Direc<strong>to</strong>rs should appoint <strong>the</strong> Vice-Chairpersonfrom among <strong>the</strong>ir number. <strong>The</strong> <strong>Panel</strong> believes <strong>the</strong> Board <strong>of</strong> Direc<strong>to</strong>rs is in <strong>the</strong> bestposition <strong>to</strong> decide how <strong>the</strong> position <strong>of</strong> Vice-Chairperson could be used - for example, forBoard training and development.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 30 <strong>of</strong> 128December, 2001
