3.3 <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs<strong>The</strong> Ministers responsible for workers’ compensation and safety have entered in<strong>to</strong> aninterjurisdictional agreement on behalf <strong>of</strong> <strong>the</strong> Governments <strong>of</strong> <strong>the</strong> NWT and Nunavut.This interjurisdictional agreement establishes <strong>the</strong> terms and conditions under which <strong>the</strong>NWT Minister, <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs, <strong>the</strong> <strong>WCB</strong>, and <strong>the</strong> Appeals Tribunal willadminister <strong>the</strong> Workers’ Compensation <strong>Act</strong> (Nunavut). In November 2001, <strong>the</strong> Ministersamended <strong>the</strong> agreement <strong>to</strong> state that it will remain in force indefinitely or until ei<strong>the</strong>rgovernment wishes <strong>to</strong> revisit <strong>the</strong> terms <strong>of</strong> <strong>the</strong> agreement. <strong>The</strong>refore, <strong>the</strong> NWT andNunavut <strong>WCB</strong> is responsible for administering a workers’ compensation system in bothterri<strong>to</strong>ries under <strong>the</strong> applicable <strong>Act</strong>.3.3.1 Size <strong>of</strong> <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rsThis is an outstanding issue from previous reviews. Respondents <strong>to</strong> <strong>the</strong> StakeholderQuestionnaire do not think current membership <strong>of</strong> 7 members, including a chairperson,needs <strong>to</strong> change. <strong>The</strong> <strong>Panel</strong> agrees.3.3.2 Authority <strong>to</strong> Appoint <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rsThis is an outstanding issue from previous reviews. Subsection 2(1) <strong>of</strong> <strong>the</strong> <strong>Act</strong>s states <strong>the</strong>NWT Minister will appoint <strong>the</strong> <strong>WCB</strong> Board <strong>of</strong> Direc<strong>to</strong>rs. Subsection 2(2.1) states that 2<strong>of</strong> <strong>the</strong>se appointments will be made on <strong>the</strong> recommendation <strong>of</strong> <strong>the</strong> Nunavut Minister.<strong>The</strong> vast majority <strong>of</strong> respondents <strong>to</strong> <strong>the</strong> Stakeholder Questionnaire felt that <strong>the</strong> Ministersshould be required <strong>to</strong> consult with stakeholders before making <strong>the</strong>ir recommendations orappointments. A significant majority <strong>of</strong> respondents thought that <strong>the</strong> Minister shouldhave <strong>to</strong> take <strong>the</strong> advice <strong>of</strong> stakeholders about appointments. Respondents identifiedgroups who represent workers, injured workers and employers as <strong>the</strong> stakeholders whomust be consulted and whose advice must be taken.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 27 <strong>of</strong> 128December, 2001
