<strong>WCB</strong> LEGISLATIVE REVIEW PANELTERMS OF REFERENCEBACKGROUNDWorkers’ Compensation <strong>Act</strong>s<strong>The</strong> fundamental principles <strong>of</strong> <strong>the</strong> workers’ compensation system provide a generalpolicy base. Any recommendations or public opinion should be measured against <strong>the</strong>seprinciples:1. <strong>The</strong> his<strong>to</strong>ric trade <strong>of</strong>f: Workers relinquish <strong>the</strong>ir right <strong>to</strong> sue employers, at common law, in return for a n<strong>of</strong>ault system <strong>of</strong> compensation, medical treatment and rehabilitation. Employers accept collective liability, and <strong>to</strong>tally fund <strong>the</strong> compensation system inreturn for protection from legal action.2. Independence and accountability: <strong>WCB</strong>s must be independent <strong>of</strong> <strong>the</strong> executive branch <strong>of</strong> government, and must beperceived as adjudicating on an independent basis. Accountability is a fundamental prerequisite for preventing misuse <strong>of</strong> delegatedpower.<strong>The</strong>se fundamental principles are incorporated in <strong>the</strong> existing Workers’ Compensation<strong>Act</strong>s.Safety <strong>Act</strong>s<strong>The</strong> Safety <strong>Act</strong> in each Terri<strong>to</strong>ry establishes <strong>the</strong> safety regulations, which govern specificestablishments or types <strong>of</strong> establishment. <strong>The</strong> purpose <strong>of</strong> occupational health and safetylegislation is <strong>to</strong> provide <strong>the</strong> required standards <strong>to</strong> ensure that workers and <strong>the</strong> generalpublic are not exposed <strong>to</strong> unsafe or hazardous workplaces.<strong>The</strong> concept <strong>of</strong> an occupational health and safety system is incorporated in <strong>the</strong> two Safety<strong>Act</strong>s. <strong>The</strong> General Regulations provide specific employers or types <strong>of</strong> employers withspecific occupational health and safety guidelines <strong>to</strong> govern <strong>the</strong>ir activities.Current StatusIn recent years, stakeholder input has suggested updating <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> <strong>Act</strong>s andGeneral Regulations. Various review panels and Standing Committees <strong>of</strong> <strong>the</strong> <strong>Legislative</strong>Assembly have made reports and recommendations; however, this has not resulted inchanges <strong>to</strong> legislation. In addition, recent legal challenges have indicated <strong>the</strong> need <strong>to</strong>revise <strong>the</strong> Workers’ Compensation <strong>Act</strong>s and Safety <strong>Act</strong>s.As a result <strong>of</strong> <strong>the</strong>se needs, <strong>the</strong> Ministers have decided <strong>to</strong> review <strong>the</strong> <strong>Act</strong>s by establishingan independent panel that would consult stakeholders and make recommendations forchange.Appendix BPage B1 <strong>of</strong> B2<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> December, 2001
