Recommendations: 4.5.1 Authority to Set Financial Penalties1. The legislation should be changed to remove the specific amounts of financialpenalties.2. The legislation should be changed to enable the Minister, on the advice of the WCBBoard of Directors, to set the level of financial penalties by regulation.3. 5.0 A Final WordThe Panel has recommended changes to legislation that will:Bring new life to the Meredith Principles.Provide for transparent use of authority and hold decision-makers andadministrators accountable.Avoid pitting stakeholders and administrators against each other.We have resisted establishing additional layers of bureaucracy or process to address someof the problems presented by stakeholders. The Panel challenges decision-makers andadministrators to prove us right in resisting this approach.The Panel’s recommendations for legislative change often flow from each other and worktogether. In many cases, the recommendations will need to work in concert to achievethe desired result.The Panel suggested an operational review be conducted immediately. We see thisoperational review as a way to enhance the results of our legislative review and completethe process for WCB renewal.When the Panel first came together, the one thing we all had in common was a desire tomake a difference and improve the workers’ compensation and safety systems in theNWT and Nunavut. This commonality of purpose was reinforced during the course ofour public consultation phase when we heard from stakeholders.We asked stakeholders to “Act Now” and provide us with their views about workers’compensation and safety legislation – and they did. The Panel now asks the WCB Boardof Directors and the Ministers to “Act Now” in response to the suggestions andrecommendations contained in our report.WCB Legislative Review Panel Report Page 128 of 128December, 2001
