Recommendations: 3.2.3 Distinction Between the WCB Board of Directorsand Corporate WCB1. The legislation should be changed to rename the Workers’ Compensation Board toreflect responsibilities for workers’ compensation and safety. It is suggested that the“Workers’ Compensation and Safety Commission” be considered.2. The legislation should be changed to define the WCB Board of Directors and thecorporate entity.3. The legislation should be changed to generally assign authority to the WCB Board ofDirectors and to enable the WCB Board of Directors to delegate authority to thecorporate entity.Recommendation: 3.2.4 Annual Reporting1. The legislation should be changed to enable the Minister to prescribe regulationsabout the content of annual reports.Recommendation: 3.2.5 Actuarial Reporting1. During the next review of the Acts, the Review Panel should be charged withreviewing the adequacy of the time frames in Section 61(4) and provided with thespecialized resources required to develop recommendations.Recommendations: 3.2.6 Regular Reviews of the Workers’ Compensation Acts1. The legislation should be changed to require the Ministers to direct an independentreview of workers’ compensation legislation, WCB Board of Directors’ policygoverning workers’ compensation, and WCB administration of the Acts.2. The legislation should be changed to require that independent reviews take place atleast once every 5 years. It is suggested that the first review should take place 1 year after legislative changesarising from this report are enacted.Recommendation: 3.2.7 Fiduciary Responsibility of the WCB Board of Directors1. The legislation should be changed to add a fiduciary responsibility clause in the Actssimilar to that now in the Financial Administration Acts.Recommendations: 3.2.8 Liability Protection for the WCB Board of Directors1. The legislation should be changed to provide specific indemnification for members ofthe WCB Board of Directors and of the Appeals Tribunal.2. This indemnification should be limited to the members’ performing their duties withthe care described in the Financial Administration Act, Section 90.Recommendations: 3.2.9 Authority to Enter into Agreements1. The legislation should be changed to enable the WCB Board of Directors to enter intoagreements with other parties for the purpose of administering the Acts.2. The legislation should be changed to enable the WCB Board of Directors to delegatesuch authority.3. It is suggested that agreements with other parties cover the protection of confidentialstakeholder information.Recommendation: 3.2.12 Authority to Own Real Property1. The legislation should be changed to enable the WCB Board of Directors to buy orsell real property for operational purposes.
