4.4 Employer Responsibilities4.4.1 Joint Work Site Health and Safety Committees<strong>The</strong> <strong>Panel</strong> was asked <strong>to</strong> consider <strong>the</strong> establishment <strong>of</strong> joint work site health and safetycommittees in <strong>the</strong> <strong>Act</strong>s. <strong>The</strong> <strong>Act</strong>s do not require <strong>the</strong> establishment <strong>of</strong> such committees,although <strong>the</strong> Chief Safety Officer may direct that one be established at a work site.Many stakeholders <strong>to</strong>ld <strong>the</strong> <strong>Panel</strong> that <strong>the</strong>y thought such committees are a good idea.<strong>The</strong>y were divided as <strong>to</strong> whe<strong>the</strong>r joint work site health and safety committees should berequired under <strong>the</strong> <strong>Act</strong>s or established voluntarily.<strong>The</strong> majority <strong>of</strong> respondents <strong>to</strong> <strong>the</strong> Stakeholder Questionnaire thought <strong>the</strong> requirement <strong>to</strong>have such committees is a good idea. <strong>The</strong> majority also thought <strong>the</strong> number <strong>of</strong> workersregularly at <strong>the</strong> work site should limit this requirement.Seven o<strong>the</strong>r jurisdictions require <strong>the</strong> establishment <strong>of</strong> joint work site health and safetycommittees. <strong>The</strong> number <strong>of</strong> workers at a work site limits this requirement. Six (6)jurisdictions place a limit <strong>of</strong> 20 workers and 1 limits <strong>the</strong> requirement <strong>to</strong> 10 workers.<strong>The</strong> <strong>Panel</strong> believes <strong>the</strong>re are significant benefits from <strong>the</strong> establishment <strong>of</strong> joint work sitehealth and safety committees.Recommendations: 4.4.1 Joint Work Site Health and Safety Committees1. <strong>The</strong> legislation should be changed <strong>to</strong> require <strong>the</strong> establishment <strong>of</strong> joint work sitehealth and safety committees at work sites having 20 or more regular workers.2. <strong>The</strong> discretion <strong>of</strong> <strong>the</strong> Chief Safety Officer <strong>to</strong> order <strong>the</strong> establishment <strong>of</strong> a joint worksite health and safety committee at those work sites with less than 20 regular workersshould be retained.<strong>WCB</strong> <strong>Legislative</strong> <strong>Review</strong> <strong>Panel</strong> <strong>Report</strong> Page 98 <strong>of</strong> 128December, 2001
