WHEREAS this Council by a vote of at least five 5 members elected theretodetermines that this ordinance is an emergency measure and that this ordinance shalltake effect at the earliest date possible as set forth in ARTICLE III SECTONS 10 and13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD and that it isnecessary for the immediate preservation of the public property health and safety andto provide for the usual daily operation of municipal departments and for the schedulingof street improvement projects Now ThereforeBE 1T ORDAINED BY THE CITY OF LAKEWOOD STATE OF OHIOSection 1 That the estimated sum of Six Hundred Forty Five Thousand FiveHundred Ninety Three and20 100 Dollars645 593 20 is hereby appropriated forthe improvement described above and the fiscal officer is hereby authorized anddirected to issue and order on the treasurer for said sum upon the requisition of theDirector of Transportation to pay the cost and expense of said improvement Wehereby agree to assume in the first instance the share of the cost and expense overand above the amount to be paid from Federal fundsSection 2 That the City hereby requests the Director ofTransportationto proceed with the aforesaid highway improvementsSection 3That the Mayor of the City of Lakewood is hereby empowered onbehalf ofthe City to enter into agreements with the Director of Transportationnecessary providing for the payment of the City of Lakewood the sum of money setforth herein above for improving the described projectSection 4 That the Clerk of Council is hereby directed to transmit a certifiedcopy of this legislation to the Director of TransportationSection 5It is found and determined that all formal actions of this Councilconcerning and relating to the passage of this ordinance were adopted in an openmeeting of this Council and that all such deliberation of the Council and of any of itscommittees that resulted in such formal action were in meetings open to the public incompliance with all legal requirementsSection 6 That this ordinance is hereby declared to be an emergencymeasure necessary for the immediate preservation of the public peace properlyhealth safety and welfare in the City and for the usual daily operation ofthe Cityforthe reasons set forth and defined in the preamble to this ordinance and provided itreceives the affirmative vote of at least five5 of its members elected to Council this
