93the firm was opened in his name but this defence cannot be consideredbecause the firm was running in his name and he used to sign on all therelevant papers on behalf of the firm.On the basis of prosecution evidences, which have already beendiscussed earlier, I find and hold the accused Sanjay Kumar Agrawal guiltyand convict for the offence U/Sec. 120-B read with Sections 420, 467, 468,471 of the Indian Penal Code.49. Accused Ram Avtar Sharma was proprietor of M/s TriptiAgency. He prepared and presented fake vouchers from Ext. 2/555 to 2/614without supply of medicine and on the basis of fake vouchers, fake Billsfrom Ext. 3/47 to 3/54 were prepared and a total sum of Rs. 4,99,599=00was withdrawn <strong>by</strong> him and deposited in his Bank Account. The medicinecompanied have deposed against him that no any supply order was receivedfrom District Animal Husbandry Office, Sahebganj and they have notsupplied any medicine to him and he was not an authorized agent of themedicine company. His firm was also not authorized <strong>by</strong> the CentralPurchase Committee.Considering all the prosecution evidences and considering thecircumstances, I find and hold the accused Ram Avtar Sharma guilty andconvict for the offence U/Sec. 120-B read with Sections 420, 467, 468, 471of the Indian Penal Code.50. Accused Gopi Nath Das, was proprietor of M/s RadhaPharmecy, Dumka. He presented fake vouchers from Ext. 2/1299 to 2/1305without supply of medicine. On the basis of forged vouchers underconspiracy with other co-accused persons forged Bills Ext. 3/141 wasprepared and passed <strong>by</strong> the Treasury Officer, Sahebganj, for a sum of Rs.31,512=00. This amount was withdrawn <strong>by</strong> the Cheque No. 580588 dated14.3.92. The medicine company has deposed that they have not received anysupply order from the District Animal Husbandry Office, Sahebganj and thisfirm was not authorized agent of the medicine company. The Batch Numberin vouchers have also denied <strong>by</strong> the medicine company.Considering all the evidences, I find and hold the accused GopiNath Das guilty and convict for the offence U/Sec. 120-B read with Sections420, 467, 468, 471 of the Indian Penal Code.
