92illegally withdrawn from the Government Treasury. The said amount wasdeposited in his Bank Account <strong>by</strong> pay-in-slip. Further this firm has notreceived any supply order from the Animal Husbandry Department. Thefirm was also not an authorized firm <strong>by</strong> the Central Purchase Committee.The prosecution has succeeded to prove his case against this accused.Considering the prosecution evidences, I find and hold the accusedSushil Kumar Sinha guilty and convict for the offence U/Sec. 120-B readwith Sections 420, 467, 468, 471 of the Indian Penal Code.Accused Sunil Kumar Sinha has also presented fake vouchers fromExt. 2/1215 to 2/1277 and fake Bills were prepared from Ext. 3/127 to3/136. He has withdrawn a total sum of Rs. 2,46,603=37 from theGovernment Treasury.Considering all these evidences, I find and hold the accused SunilKumar Sinha guilty and convict for the offence U/Sec. 120-B read withSections 420, 467, 468, 471 of the Indian Penal Code.47. Accused Smt. Sarswati Chandra was proprietor of M/s S.R.Enterprises, Patna and her husband accused Mahendra Prasad is the Managerof M/s S.R. Enterprises, Patna. Without supply of medicines they haveproduced fake vouchers from Ext. 2/615 to 2/806 and fake Bills wereprepared from Ext. 3/55 to 3/74. On the basis of these fake Bills, they havereceived Rs. 9,51,639=26 in the name of their firm M/s S.R. Enterprises,Patna.Considering all these evidences, I find and hold both the accusedpersons Sarswati Chandra and Mahendra Prasad guilty and convict for theoffence U/Sec. 120-B read with Sections 420, 467, 468, 471 of the IndianPenal Code.48. Accused Sanjay Kumar Agrawal was proprietor of M/s SanjayCattle Feeds & General Supplier, Dumka. Without supply of Barseem Seedhe presented fake vouchers in Animal Husbandry Department from Ex.t2/397 to 2/514 and fake Bills from Ext. 3/37 to 3/46 were prepared andpresented for withdrawals of Government money. A total sum of Rs.6,00,000=00 was withdrawn from the Government Treasury. It is hisdefence that he was a servant of Shesh Muni Ram and under his direction
