91has been shown <strong>by</strong> the Suppliers for supply of medicine to the AnimalHusbandry Department. It has already been discussed earlir and no need torepeat the same.Prosecution has succeeded to prove this fact that without supply ofmedicine and in few cases short supply was done and fake certificate hasbeen issued about the supply of medicines.45. Accused Tripurari Mohan Prasad was Proprietor of M/s BiharSurgico Medico Agency, Patna and the Director of M/s MastrinPharmaceuticals, Patna. Without supply of medicine he filed fake vouchersand invoices from Ext. 2/1053 to 2/1175 and Ext. 2/1176 to 2/1214 andunder conspiracy with other co-accused persons fake Bills were preparedfrom Ext. 3/107 to 3/120 and Ext. 3/121 to 3/126. On the basis of theseforged bills a total sum of Rs. 24,58,226=00 was withdrawn <strong>by</strong> him. Fromperusal of Ext. 15/108 to 15/112, it is quite apparent that the medicine forwhich fake vouchers were prepared that medicine has not been produced <strong>by</strong>M/s Hiler Private Limited. No any supply order was received <strong>by</strong> his firmand his firm was not an authorized firm to supply the medicine to AnimalHusbandry Department.Considering all the evidences against the accused Tripurari MohanPrasad, I here<strong>by</strong> find and hold this accused guilty and convict for the offenceU/Sec. 120-B read with Sections 420, 467, 468, 471 of the Indian PenalCode.46. Accused Sushil Kumar Sinha was Proprietor of M/s SamarpanVeterinary Pvt. Limited. He stated in his defence that he was only aproprietor in paper but all the work were managed <strong>by</strong> his elder brotheraccused Tripurari Mohan Prasad. Same defence has been taken <strong>by</strong> accusedSunil Kumar Sinha, proprietor of M/s <strong>Sri</strong> Baba Chemical Works, Patna thathe was proprietor in paper and all the works were looked out <strong>by</strong> his elderbrother accused Tripurari Mohan Prasad.This defence cannot save their skin from the criminal liabilities. Theyare fully liable for the act of the said firms.By accused Sushil Kumar Sinha without supply of medicine fakevouchers from Ext. 2/894 to 2/1065 were presented and fake bills wereprepared from Ext. 3/89 to 3/106 and a total sum of Rs. 8,24,826=00 was
