75The Account was opened in the name of M/s Gauri Distributors, Bhagalpurand according to the Partnership Deed accused Phul <strong>Singh</strong> and SushilKumar Jha were partners. The Partnership Deed bears the signature of boththese persons. The specimen signature is Ext. 36 and 36/1. He also provedExt. 29/1 i.e. Pay-in-Slip <strong>by</strong> which the said amount was deposited in theBank Account of this firm. The signature of accused Phul <strong>Singh</strong> wasidentified <strong>by</strong> this witness on the back side of the Bank Draft i.e. Ext. 30/4.P.W. 48 Anand Vikram, Manager S.B.I. Bhagalpur, in his presencefive Bank Drafts were seized out of which one Bank Draft belongs to M/sGauri Distributor, Bhagalpur. That seizure list is Ext. 16/14.29. In respect of accused Arun Kumar <strong>Singh</strong>, partner of M/sVishwakarma Agency, Deoghar. According to the prosecution case withoutsupply of medicine he submitted fake supply vouchers in District AnimalHusbandry Office, Sahebganj. That vouchers are Ext. 2.1313 to 2/1314. ONthe basis of these fake vouchers in connivance with other co-accused personsforged bills were passed. The bill is Ext. 3/143. Under the conspiracywithout supply of medicine on the basis of forged Bill Ext. 3/143 the totalamount of Rs. 7,000=00 (Seven thousand) was withdrawn <strong>by</strong> MTA DraftNo. 16/108159 dated 31.3.93 and that was deposited in the Bank Account ofthe said firm. This fact was confirmed with Bill Book i.e. Ext. 5/1 and CashBook Ext. 7/3.The witness of medicine manufacturing companies stated that theyhave not received any Supply Order from District Animal Husbandry officeand the firm was not authorized to supply the medicine. The Batch Numberwhich was shown in the vouchers that have been supplied to this firm andthis firm was also not authorized to supply. The name of this firm was alsonot approved <strong>by</strong> the Ext. 13/1 i.e. a list of approved authorized firm <strong>by</strong>Central Purchase Committee.P.W. 79 Surya Narayan Pandey, Police Inspector of CID statedin para-10 that during course of investigation it was found that VishwakarmaAgency is a joint Partnership firm and Arun Kumar <strong>Singh</strong> and Shiv Raj Ramwere the partners of this firm. Father of accused Arun Kumar <strong>Singh</strong>, Dr.Jugal Kishore <strong>Singh</strong> was District Animal Husbandry officer in Sahebganj.
