74Account. Ext. 4 is N.C. Register. Ext. 5/1 is Bill Book and Cash Book isExt. 7/2. From perusal of these documents his involvements have beenestablished. His specimen signature was also taken by the I.O. TheSpecimen Signature is Ext. 98/26 to 98/34. The firm of this accused wasalso not authorized firm by the Central Purchase Committee.P.W. 16 Arun Kumar Mishra stated in para-11 that M/s RadhaPharmacy is stockiest of their company but medicine Flexa BC 5 kg BatchNo. V-13259 was never supplied to this firm.It goes to show that this medicine was never supplied to him but fakeinvoices of this medicine was produced by this accused in the DistrictAnimal Husbandry Office, Sahebganj and on the basis of fake vouchers andBills government money was withdrawn from the Government Treasury.28. In respect of accused Phul Singh, it is alleged that he wasProprietor of M/s Gauri Distributors, Bhagalpur. The other partner of thisfirm accused Sushil Kumar Jha has pleaded his guilt and accordingly he wasconvicted earlier. In respect of this accused Phul Singh on behalf of theprosecution the fake and forged vouchers from Ext. 2/1306 to 2/1312 havebeen proved. It is alleged that without supply of medicine these fakevouchers have been prepared and presented by this accused in the AnimalHusbandry Office, Sahebganj. On this basis of these fake vouchers inconnivance with other co-accused persons and officials of AHD andTreasury office, Sahebganj forged Bill Ext. 3/142 was prepared and a totalamount of Rs. 34,837=00 (Thirty-four thousand Eight hundred Thirty-seven)was withdrawn from the Government Treasury. Ext. 30/4 is Bank Draft ofRs. 34,937=00. This amount of Bank Draft was deposited in the BankAccount No. 1378 (Ext.31/1) through Pay-in-Slip Ext. 29/1. The Ledgersheet of the statement of account is Ext. 32/1. It also appears from perusal ofBank Draft that signature of this accused has been found on the back of theBank Draft i.e. Ext. 30/4. Ext. 13/1 is the list of authorized Suppliersapproved by the Central Purchase Committee. This firm M/s GauriDistributor, Bhagalpur was not authorized to supply medicine in the DistrictAnimal Husbandry Office, Sahebganj. No any order of supply was sent fromthe District Animal Husbandry Office, Sahebganj to this firm.P.W. 39 Anil Madhav Kulkarni, Scale I officer of Canara Bankproved Ext. 31/1 i.e. Bank Account Opening Form of Account No. 1398.
75The Account was opened in the name of M/s Gauri Distributors, Bhagalpurand according to the Partnership Deed accused Phul Singh and SushilKumar Jha were partners. The Partnership Deed bears the signature of boththese persons. The specimen signature is Ext. 36 and 36/1. He also provedExt. 29/1 i.e. Pay-in-Slip by which the said amount was deposited in theBank Account of this firm. The signature of accused Phul Singh wasidentified by this witness on the back side of the Bank Draft i.e. Ext. 30/4.P.W. 48 Anand Vikram, Manager S.B.I. Bhagalpur, in his presencefive Bank Drafts were seized out of which one Bank Draft belongs to M/sGauri Distributor, Bhagalpur. That seizure list is Ext. 16/14.29. In respect of accused Arun Kumar Singh, partner of M/sVishwakarma Agency, Deoghar. According to the prosecution case withoutsupply of medicine he submitted fake supply vouchers in District AnimalHusbandry Office, Sahebganj. That vouchers are Ext. 2.1313 to 2/1314. ONthe basis of these fake vouchers in connivance with other co-accused personsforged bills were passed. The bill is Ext. 3/143. Under the conspiracywithout supply of medicine on the basis of forged Bill Ext. 3/143 the totalamount of Rs. 7,000=00 (Seven thousand) was withdrawn by MTA DraftNo. 16/108159 dated 31.3.93 and that was deposited in the Bank Account ofthe said firm. This fact was confirmed with Bill Book i.e. Ext. 5/1 and CashBook Ext. 7/3.The witness of medicine manufacturing companies stated that theyhave not received any Supply Order from District Animal Husbandry officeand the firm was not authorized to supply the medicine. The Batch Numberwhich was shown in the vouchers that have been supplied to this firm andthis firm was also not authorized to supply. The name of this firm was alsonot approved by the Ext. 13/1 i.e. a list of approved authorized firm byCentral Purchase Committee.P.W. 79 Surya Narayan Pandey, Police Inspector of CID statedin para-10 that during course of investigation it was found that VishwakarmaAgency is a joint Partnership firm and Arun Kumar Singh and Shiv Raj Ramwere the partners of this firm. Father of accused Arun Kumar Singh, Dr.Jugal Kishore Singh was District Animal Husbandry officer in Sahebganj.
