He also reported that he visited AHD Directorate and inquiredabout the Allotment Nos. 3971 and 3769 both of dated 26.7.95 and onverification Dr. Ram Raj Ram, Director, AHD Directorate informed himvide Letter No. 1076 dated 13.2.96 that above said both the AllotmentLetters were not issued <strong>by</strong> his office. During course of investigation RamKishore Ram handed over these two letters dated 13.2.96 to him in theofficial course of business. Both the letters have been marked as Ext. 15/36and Ext. 15/37 respectively.From perusal of Ext. 13/1, it appears that this firm was not listed andnot authorized <strong>by</strong> Central Purchase Committee, AHD to supply the medicineto the Department.24. Accused Smt. Saraswati Chandra was Proprietor of M/s. S.R.Enterprises, Patna and accused Mahendra Prasad was the Manager of M/sS.R. Enterprises, Patna. Without supply of medicine in District AnimalHusbandry Office, Sahebganj filed fake vouchers in the said Department andon the basis of these fake vouchers Bills were submitted and the amount waswithdrawn from the Government Treasury. From Ext. 2/615 to Ext. 2/806were prepared <strong>by</strong> this firm and under conspiracy with District AnimalHusbandry Officers, T.V.O.(M) Sahebganj and Officers and Employees ofSahebganj Treasury they presented fake Bills from Ext. 3/55 to 3/74 forwithdrawal of the amount of Rs. 9,51,639=26 (Nine lakhs Fifty-onethousand Six hundred Thirty-nine and paise twenty-six). Without supply ofmedicine they have fraudulently withdrawn this amount from Bank Drafts.The Bank Drafts are from Ext. 30/59 to Ext. 30/64. This amount wasdeposited in S.B.I Bank Account No. 2855 i.e. Ext. 31/7 and the statementof Accounts is Ext. 32/6. All the Bank Drafts bear the signature of accusedSmt. Saraswati Chandra on the back portion of the Bank Drafts. Ext. 13/1 islist of authorized firms <strong>by</strong> the Central Purchase Committee and this firm M/sS.R. Enterprises, Patna was not an authorized firm to supply the medicine inthe Animal Husbandry Department.The medicine companies have deposed before the Court that thementioned Batch Number of medicines have not been manufactured <strong>by</strong> thecompany and that Batch Number was never supplied to this firm to supply inAnimal Husbandry Department.
