Furtherhe proved, in para-7, the Account Opening Form and statement of Accountof M/s Mastrin Pharmaceuticals Limited i.e. Ext. 31/9 and Ext. 32/8. Furtherhe proved Pay-in-Slip Ext. 29/42, in respect of Current Account No. 178belongs to M/s Mastrin Pharmaceuticals Limited. In para-12 he furtherproved Account Opening Form and Statement of Accounts of M/s BiharSurgico Medico Agency, Patna related to his S.B.I. Account No. 118, thathas been marked as Ext. 31/12 and 32/11 respectively.22. In respect of accused Sushil Kumar Sinha, according to theprosecution case he was Proprietor of M/s Samarpan Veterinary Enterprises,Patna. It is alleged that without supply of medicine he prepared forged andfake vouchers. Further with conspiracy of District Animal HusbandryOffice, Sahebagnaj and T.V.O (M) Sahebganj and also with conspiracy ofTreasury Officers, Sahebaganj and employees of Sahebganj Treasury forgedbills were prepared and on the basis of forged and fake vouchers governmentmoney was withdrawn to the extent of Rs. 8,24,826=10 (Rupees Eight lakhsTwenty-four thousand Eight hundred Twenty-six and paise ten). The Bankdrafts was received for the said amount and it was deposited in the BankAccount of the said firm.On behalf of the prosecution the alleged fake and forgedvouchers have been proved from Ext. 2/894 to Ext. 2/1065. According tothe prosecution case, all these vouchers were prepared by this accused in the
65name of his firm M/s Samarpan Veterinary Enterprises, Patna withoutsupply of any medicine. From Ext. 3/89 to Ext. 3/106 are the Bills whichwere alleged to be prepared on the basis of forged vouchers. The Bills werepassed under a criminal conspiracy with the help of other co-accusedpersons. From Ext. 30/78 to Ext. 30/93 are the Bank Drafts of the totalamount of Rs. 8,24,826=10, which was withdrawn from the GovernmentTreasury and by Ext. 29/43 to Ext. 29/46 all are Pay-in-Slips and with thesePay-in-Slips the amount was deposited in the S.B.I. Account No. 170. TheAccount Opening Form which are Ext. 31/10 to Ext. 31/11 and theStatement of Accounts are Ext. 31/9 and Ext. 31/10. It also appears fromperusal of Ext. 30/78 to Ext. 30.93 that each bears the signature of accusedSushil Kumar Sinha.The medicine companies have deposed before the Court that theyhave not received any Supply Order from the office of District AnimalHusbandry Officer, Sahebganj and further they have told that M/s SamarpanVeterinary Enterprises, Patna was not authorized from the medicinecompany to supply the medicines. The Medicine manufacturing companieshave also stated that the specific Batch Numbers have not been prepared bythem and they have not sold that Batch numbers to this firm. Ext. 13/1 thelist of Authorized Medicine Suppliers, this also goes to show that thisMedicine firms was not authorized by the Central Purchase Committee.P.W. 16 is Arun Kumar Mishra, Marketing Controller of ConceptPharmaceuticals Limited, which is a manufacturing unit of medicine ofhuman and veterinary. This is a Mumbai based company. This witnessstated in para-10 of his deposition that M/s Samarpan VeterinaryEnterprises, Patna is not their Stockiest and they have not supplied anymedicine to this firm.P.W. 32 Madhukar Varma is a Sales Manager in M.K. Works (H)Veterinary Limited, which is a medicine manufacturing unit. He stated inpara-6 that his company has not received any Supply Order from the AnimalHusbandry Department for delivery of any medicine.P.W. 35 is Sudarshan Kumar Bansal discloses in para-9 of hisdeposition about the property which was alleged in the name of co-accusedTripurari Mohan Prasad and in the name of this accused person.
