of a State having a Legislative Council, by each House of theLegislature of that State.Article 243ZG Bar to interference by Courts in electoral mattersNotwithstanding anything in this Constitution, —(a) the validity of any law relating to the delimitation ofconstituencies or the allotment of seats to such constituenciesmade or purporting to be made [under] Article 243ZA shall notbe called in question in any Court;(b) no election to any Municipality shall be called in questionexcept by an election petition presented to such authority and insuch manner as is provided for by or under any law made bythe Legislature of a State.Part X The Scheduled and Tribal AreasArticle 244 Administration of Scheduled Areas and TribalAreas(1) The provisions of the Fifth Schedule shall apply to theadministration and control of the Scheduled Areas andScheduled Tribes in any State other than the States of Assam,Meghalaya, Tripura and Mizoram.(2) The provisions of the Sixth Schedule shall apply to theadministration of the tribal areas in the States of Assam,Meghalaya, Tripura and Mizoram.Article 244A Formation of an autonomous State comprisingcertain tribal areas in Assam and creation of local Legislature orCouncil of Ministers or both therefor(1) Notwithstanding anything in this Constitution, Parliamentmay, by law, form within the State of Assam an autonomousState comprising (whether wholly or in part) all or any of thetribal areas specified in Part I of the table appended toparagraph 20 of the Sixth Schedule and create therefor -(a) a body, whether elected or partly nominated and partlyelected, to function as a Legislature for the autonomous State,or(b) a Council of Ministers,or both with such constitution, powers and functions, in eachcase, as may be specified in the law.(2) Any such law as is referred to in clause (1) may, inparticular, -(a) specify the matters enumerated in the State List or theConcurrent List with respect to which the Legislature of theautonomous State shall have power to make laws for the wholeor any part thereof, whether to the exclusion of the Legislatureof the State of Assam or otherwise;(b) define the matters with respect to which the executive powerof the autonomous State shall extend;(c) provide that any tax levied by the State of Assam shall beassigned to the autonomous State in so far as the proceedsthereof are attributable to the autonomous State;(d) provide that any reference to a State in any article of thisConstitution shall be construed as including a reference to theautonomous State; and(e) make such supplemental, incidental and consequential

provisions as may be deemed necessary.(3) An amendment of any such law as aforesaid in so far assuch amendment relates to any of the matters specified insub-clause (a) or sub-clause (b) of clause (2) shall have noeffect unless the amendment is passed in each House ofParliament by not less than two-thirds of the members presentand voting.(4) Any such law as is referred to in this article shall not bedeemed to be an amendment of this Constitution for thepurposes of article 368 notwithstanding that it contains anyprovision which amends or has the effect of amending thisConstitution.Part XI Relations Between the Union and the StatesChapter I Legislative RelationsArticle 245 Extent of laws made by Parliament and by theLegislatures of States(1) Subject to the provisions of this Constitution, Parliamentmay make laws for the whole or any part of the territory ofIndia, and the Legislature of a State may make laws for thewhole or any part of the State.(2) No law made by Parliament shall be deemed to be invalidon the ground that it would have extra-territorial operation.Article 246 Subject-matter of laws made by Parliament and bythe Legislatures of States(1) Notwithstanding anything in clauses (2) and (3), Parliamenthas exclusive power to make laws with respect to any of thematters enumerated in List I in the Seventh Schedule (in thisConstitution referred to as the "Union List").(2) Notwithstanding anything in clause (3), Parliament, and,subject to clause (1), the Legislature of any State also, havepower to make laws with respect to any of the mattersenumerated in List III in the Seventh Schedule (in thisConstitution referred to as the "Concurrent List").(3) Subject to clauses (1) and (2), the Legislature of any Statehas exclusive power to make laws for such State or any partthereof with respect to any of the matters enumerated in List IIin the Seventh Schedule (in this Constitution referred to as the"State List").(4) Parliament has power to make laws with respect to anymatter for any part of the territory of India not included in aState notwithstanding that such matter is a matter enumeratedin the State List.Article 247 Power of Parliament to provide for theestablishment of certain additional courtsNotwithstanding anything in this Chapter, Parliament may bylaw provide for the establishment of any additional courts forthe better administration of laws made by Parliament or of anyexisting law with respect to a matter enumerated in the UnionList.Article 248 Residuary powers of legislation
