any time before the commencement of theConstitution (Twenty-sixth Amendment) Act, 1971, wasrecognised by the President as the Ruler of an Indian State orany person who, at any time before such commencement, wasrecognised by the President as the successor of such Ruler;(23) "Schedule" means a Schedule to this Constitution;(24) "Scheduled Castes" means such castes, races or tribes orparts of or groups within such castes, races or tribes as aredeemed under article 341 to be Scheduled Castes for thepurposes of this Constitution;(25) "Scheduled Tribes" means such tribes or tribalcommunities or parts of or groups within such tribes or tribalcommunities as are deemed under article 342 to be ScheduledTribes for the purposes of this constitution;(26) "securities" includes stock;(27) "sub-clause" means a sub-clause of the clause in whichthe expression occurs;(28) "taxation" includes the imposition of any tax or impost,whether general or local or special, and "tax" shall be construedaccordingly;(29) "tax on income" includes a tax in the nature of an excessprofits tax;(29A) "tax on the sale or purchase of goods" includes -(a) a tax on the transfer, otherwise than in pursuance of acontract, of property in any goods for cash, deferred paymentor other valuable consideration;(b) a tax on the transfer of property in goods (whether as goodsor in some other form) involved in the execution of a workscontract;(c) a tax on the delivery of goods on hire-purchase or anysystem of payment by installments;(d) a tax on the transfer of the right to use any goods for anypurpose (whether or not for a specified period) for cash,deferred payment or other valuable consideration;(e) a tax on the supply of goods by any unincorporatedassociation or body of persons to a member thereof for cash,deferred payment or other valuable consideration;(f) a tax on the supply, by way of or as part of any service or inany other manner whatsoever, of goods, being food or anyother article for human consumption or any drink (whether ornot intoxicating), where such supply or service is for cash,deferred payment or other valuable consideration,and such transfer, delivery or supply of any goods shall bedeemed to be a sale of those goods by the person making thetransfer, delivery or supply and a purchase of those goods bythe person to whom such transfer, delivery or supply is made;(30) "Union territory" means any Union territory specified in theFirst Schedule and includes any other territory comprised withinthe territory on India but not specified in that Schedule.Article 367 Interpretation(1) Unless the context otherwise requires, the General ClausesAct, 1897, shall, subject to any adaptations and modificationthat may be made therein under article 372, apply for theinterpretation of this Constitution as it applies for theinterpretation of an Act of the Legislature of the Dominion of
India.(2) Any reference in this Constitution to Acts or laws of, ormade by, Parliament, or to Acts or laws of, or made by, theLegislature of a State, shall be construed as including areference to an Ordinance made by the President or, to anOrdinance made by a Governor, as the case may be.(3) For the purposes of this Constitution "foreign State" meansany State other than India:Provided that, subject to the provisions of any law made byParliament, the President may be order declare any State notto be a foreign State for such purposes as may be specified inthe order.Part XX Amendment of the ConstitutionArticle 368 Power of Parliament to amend the Constitution andprocedure therefor(1) Notwithstanding anything in this Constitution, Parliamentmay in exercise of its constituent power amend by way ofaddition, variation or repeal any provision of this Constitution inaccordance with the procedure laid down in this article.(2) An amendment of this Constitution may be initiated only bythe introduction of a Bill for the purpose in either House ofParliament, and when the Bill is passed in each House by amajority of the total membership of that House and by amajority of not less than two-thirds of the members of thatHouse present and voting, it shall be presented to the Presidentwho shall give his assent to the Bill and thereupon theConstitution shall stand amended in accordance with the termsof the Bill:Provided that if such amendment seeks to make any change in-(a) article 54, article 55, article 73, article 162 or article 241, or(b) Chapter IV of Part V, Chapter V of Part VI, or Chapter I ofPart XI, or(c) any of the Lists in the Seventh Schedule, or(d) the representation of States in Parliament, or(e) the provisions of this article,the amendment shall also require to be ratified by theLegislatures of not less than one-half of the States byresolutions to that effect passed by those Legislatures beforethe Bill making provision for such amendment is presented tothe President for assent.(3) Nothing in article 13 shall apply to any amendment madeunder this article.(4) No amendment of this Constitution (including the provisionsof Part III) made or purporting to have been made under thisarticle whether before or after the commencement of section 55of the Constitution (Forty-second Amendment) Act, 1976 shallbe called in question in any court on any ground.(5) For the removal of doubts, it is hereby declared that thereshall be no limitation whatever on the constituent power ofParliament to amend by way of addition, variation or repeal theprovisions of this Constitution under this article.Part XXI Temporary, Transitional and Special Provisions
