Legislature <strong>of</strong> such State enacted by virtue <strong>of</strong> powers conferredby this <strong>Constitution</strong>, sue or be sued in relation to theirrespective affairs in the like cases as the Dominion <strong>of</strong> <strong>India</strong> andthe corresponding Provinces or the corresponding <strong>India</strong>n Statesmight have sued or been sued if this <strong>Constitution</strong> had not beenenacted.(2) If at the commencement <strong>of</strong> this <strong>Constitution</strong> -(a) any legal proceedings are pending to which the Dominion <strong>of</strong><strong>India</strong> is a party, the Union <strong>of</strong> <strong>India</strong> shall be deemed to besubstituted for the Dominion in those proceedings; and(b) any legal proceedings are pending to which a Province or an<strong>India</strong>n State is a party, the corresponding State shall bedeemed to be substituted for the Province or the <strong>India</strong>n State inthose proceedings.Chapter IV Right to PropertyArticle 300A Persons not to be deprived <strong>of</strong> property save byauthority <strong>of</strong> lawNo person shall be deprived <strong>of</strong> his property save by authority <strong>of</strong>law.Part XIII Trade, Commerce and Intercourse Within theTerritory <strong>of</strong> <strong>India</strong>Article 301 Freedom <strong>of</strong> trade, commerce and intercourseSubject to the other provisions <strong>of</strong> this Part, trade, commerceand intercourse throughout the territory <strong>of</strong> <strong>India</strong> shall be free.Article 302 Power <strong>of</strong> Parliament to impose restrictions ontrade, commerce and intercourseParliament may by law impose such restrictions on the freedom<strong>of</strong> trade, commerce or intercourse between one State andanother or within any part <strong>of</strong> the territory <strong>of</strong> <strong>India</strong> as may berequired in the public interest.Article 303 Restrictions on the legislative powers <strong>of</strong> the Unionand <strong>of</strong> the States with regard to trade and commerce(1) Notwithstanding anything in article 302, neither Parliamentnor the Legislature <strong>of</strong> a State shall have power to make any lawgiving, or authorising the giving <strong>of</strong>, any preference to one Stateover another, or making, or authorising the making <strong>of</strong>, anydiscrimination between one State and another, by virtue <strong>of</strong> anyentry relating to trade and commerce in any <strong>of</strong> the Lists in theSeventh Schedule.(2) Nothing in clause (1) shall prevent Parliament from makingany law giving, or authorising the giving <strong>of</strong>, any preference ormaking, or authorising the making <strong>of</strong>, any discrimination if it isdeclared by such law that it is necessary to do so for thepurpose <strong>of</strong> dealing with a situation arising from scarcity <strong>of</strong>goods in any part <strong>of</strong> the territory <strong>of</strong> <strong>India</strong>.Article 304 Restriction on trade, commerce and intercourseamong StatesNotwithstanding anything in article 301, the Legislature <strong>of</strong> aState may by law -
