August 2010 17 8848• Lay down general principles for governing heritage resources management throughoutthe Republic;• Introduce an integrated system for the identification, assessment and management ofthe heritage resources of South Africa;• Establish the South African Heritage Resources Agency together with its Council to coordinateand promote the management of heritage resources at national level;• Set norms and maintain essential national standards for the management of heritageresources in the Republic and to protect heritage resources of national significance;• Control the export of nationally significant heritage objects and the import into theRepublic of cultural property illegally exported from foreign countries;• Enable the provinces to establish heritage authorities which must adopt powers toprotect and manage certain categories of heritage resources; and• Provide for the protection and management of conservation-worthy places and areas bylocal authorities; and to provide for matters connected therewith.2.5.7 Occupational Health and Safety Act (Act 85 of 1993)The Occupation Health and Safety Act (OHSA) makes provisions that address the healthand safety of persons working on the site.The objectives of the act are to:• Provide for the health and safety of persons at work and for the health and safety ofpersons in connection with the use of plant and machinery;• Protect persons other than persons at work against hazards to health and safety arisingout of or in connection with the activities of persons at work;• Establish an advisory council for occupational health and safety; and• Provide for matters connected therewith.2.5.8 Provincial Gazette Extraordinary, 9 February 2005, No 43 109-Solid waste Bylawsfor the Emfuleni Local MunicipalityIn terms of chapter 7 of the Constitution of the Republic of South Africa, Act 108 of 1996,section 152(1) (b) lists as an object of Local Government to ensure the provision of servicesto communities in a sustainable manner and (d) to promote a safe and healthy environmentand to exercise the power and functions of municipalities as set out in section 156.The Sedibeng District Municipality has a duty to ensure that residents of the DistrictMunicipality have a safe and healthy environment by ensuring that waste is handled anddisposed of in a responsible and environmentally friendly manner.
