Mr. Breaud replied you knowwhen I started saying we need to do something immediately I think we need to do some immediatestuff and then we’ll have some long term solutions but to have a moratorium for a year to me isgetting a little bit on the ridiculous side, we need to clarify this issue and move forward with it. Mr.Jeff Donnes came forward and stated will <strong>South</strong> <strong>Central</strong> <strong>Planning</strong> be the one helping you all makedecisions on what goes where, Clay? Mr. Breaud replied most definitely, we’re going to rely ontheir pr<strong>of</strong>essional opinions on recommendations, we may not agree with everything but we’re goingto listen them and that is why I was glad to see the options, they can’t answer all <strong>of</strong> the questions,some <strong>of</strong> these I mean we can’t answer them all. That is why we’re asking for the public input,some <strong>of</strong> these things are going to end up being some political decisions probably down the road,we’re not a political board, we would like to make our recommendations on what is best for thehealth and safety <strong>of</strong> the <strong>City</strong> and we’ll make that recommendation to the Council, if the Councildecides they don’ t like our recommendation and they want to change it well so be it, but we’regoing to make our recommendation based on sound, pr<strong>of</strong>essional advice. Mr. Donnes replied ok,so they will make this recommendation, a recommendation specifically too, Simone onmanufacture and modular homes and where to put it to you all. Mr. Breaud replied yes. Mr.Donnes replied ok. Mr. Breaud stated you the way I see this is next month they’re going to comeback to us with some changes and take some options out and it is going to be up to this board toagree to those options or say we don’t like that option we want to go to the other one and then fromthat point forward we’ll make a recommendation to the <strong>City</strong> Council with those recommendations.Ms. Jenny Morvant, <strong>City</strong> Council Administrator came forward and stated I’m confused also Errolbecause when the conversation came up at the meeting concerning the building on North Canal, itwas my understanding that Mr. Badeaux explained to you that if you had a plan that wasspecifically stamped modular that he no problem with that, he has issues with the aesthetics <strong>of</strong> thebuilding but he concurred with your decision to allow that permit. You also mentioned the HeadStart building and he told you if was truly a modular to issue the permit, so I don’t understand; Idon’t recall we’d have to go back and look into the minutes because he made the statement thatnobody would arrest me and bring me to jail if I gave a permit and his understanding was thatanything that came on wheels was prohibited. Ms. Morvant stated I think his concern was he feltthat anything that come on wheels could not be considered modular but once I explained to himabout the plans and the specs that you submitted to me that it was clearly stamped that it meet the2006… Mr. Price replied he agreed to let that one and when we brought up the Head Startprogram that is when he made the statement, you do what you think and then nobody is going tocome and arrest you. Mr. Price replied well I’m not going to issue a permit if I’m not sure and thelaw is clear and that is why I asked him. Ms. Morvant stated the moratorium in my opinion wasintended for manufactured, mobile type homes because there was no definition <strong>of</strong> modular theCouncil, it was their intent and what they are really waiting for to release this moratorium is precisedefinitions as Simone has in here that, they by all means want that included as a recommendationfrom the Board. Mr. Breaud replied thank you and I think this will go a long way to get thedefinitions out so that is why I think we need to move on this as quickly as possible, does anybodyelse like to make any comments? Mr. Badeaux replied I thought I understood before I walked inhere, Simone is it your recommendation or suggestion or opinion to the <strong>Planning</strong> and <strong>Zoning</strong>Commission that it is not legal to not allow modular homes built to construction standards whereever a stick construction can be built. Ms. Caesar replied you cannot prohibit a modular home fromgoing into a residential area because it adheres to the same building codes as a site built home.Mr. Badeaux replied so call it what you want if there is a set <strong>of</strong> stamped construction plans andthose plans meet the building codes that should be able to go wherever a stick built home couldgo. Ms. Caesar replied if it is a modular home, yes. Mr. Badeaux replied with the constructionplans built to those same standards and specifications. Ms. Caesar replied correct. Mr. Kearnsstated they would have to provide the inspections, they would have had to have gone through theinspection process during the course <strong>of</strong> construction, it wouldn’t just be a set <strong>of</strong> plans, am I correctwith that, Errol? Mr. Price replied correct, Louisiana law says that it can be built at a factory, theyactually have to submit us the inspection reports, they have to give us the name <strong>of</strong> the inspector,the time and the date it was done and what inspection was done on each item. Mr. Badeauxreplied ok, so if it was built in North Carolina, there are inspections that are required where everthey are built. Mr. Price replied they have to meet the Louisiana codes. Mr. Badeaux replied theNational Codes, National standard now isn’t it? Mr. Price replied the International is standard butnot all states adopted it, if you go to Florida, they’ve got the Florida code. I’ll give you an example,the company that deals mostly in <strong>Thibodaux</strong> is from Alabama, their plans had an engineer’s stampand they’ll stamp all <strong>of</strong> the states and they’ll state each code that they built it according to, a lot <strong>of</strong>your codes are close and then we get the plans and we review them; then we would request theinspection reports <strong>of</strong> when it was built. Mr. Badeaux stated and they have those? Mr. Price repliedmost <strong>of</strong> the time they have those, the last issue I had the company went bankrupt and they cannotget them so it is up to the personal owner now on how they are handling that. Mr. Badeaux repliedall right. Mr. Breaud stated that the thing to make sure before anyone in the <strong>City</strong> buys a modularhome that they make sure that it meets the codes and the inspections that the <strong>City</strong> requires beforeyou bring it down here and you have it delivered. Does anybody else want to make comments onmodular and mobile homes, if not we’ll move forward to Industrial Zones.Industrial Zones – Short term and long term recommendations on Industrial Zones, I think whatbrought this up there was somebody requesting having a recycling transfer station within the <strong>City</strong><strong>of</strong> <strong>Thibodaux</strong> and I think <strong>South</strong> <strong>Central</strong> <strong>Planning</strong> has come back and basically says the buffer1491
