4.3 What is an ECM?<br />

After a vehicle is placed in service, an Entity in Charge of its maintenance has to be designated<br />

and to be identified in the National Vehicle Register. An ECM may be, but not limited to, a Railway<br />

Undertaking, an Infrastructure Manager or a keeper.<br />

In accordance with the Railway Safety Directive and FOR FREIGHT WAGONS ONLY, the ECM<br />

shall be certified in accordance with the regulation 445/2011, article 2(1).<br />

4.4 Who can be an ECM?<br />

An ECM may be, but not limited confirmed by the European Commission, a Railway Undertaking,<br />

an Infrastructure Manager or a keeper.<br />

The ECM is the body reguistered as such in the NVRs. There are no conditions of nationality to<br />

become an ECM. An ECM established outside the EU or outside the contracting countries of OTIF<br />

can provide maintenance to wagons used on the railway system of the EU or of the contracting<br />

countries of OTIF . In that case the ECM has to be certified against the ECM Regulation or its<br />

equivalent in OTIF rules.<br />

4.5 How many ECMs can a vehicle have?<br />

Article 33(2) of Directive 2008/57/EC provides that the NVR is to contain, among other compulsory<br />

information, the identification of the owner of the vehicle and the entity in charge of maintenance.<br />

Decision 2007/756/EC, amended by the Decision 2011/107/EU, establishes the requirements for<br />

the information to be contained in the NVR and, for each vehicle, the data relative to the ECM<br />

(and not several ECM) has to be compulsorily fulfilled. Then a vehicle can only have one ECM<br />

assigned in the NVR<br />
