Data quality<br />

The work on improv<strong>in</strong>g data quality has cont<strong>in</strong>ued us<strong>in</strong>g <strong>the</strong> same<br />

approach developed for <strong>the</strong> previous years’ submissions. All <strong>the</strong><br />

<strong>in</strong>dicators have been checked for consistency and fluctuation,<br />

and a comparison with <strong>the</strong> Eurostat data has been carried out.<br />

There are cont<strong>in</strong>uous improvements <strong>in</strong> data quality; this year it<br />

has also been possible to update <strong>the</strong> data reported <strong>in</strong> previous<br />

years. Therefore, <strong>the</strong> CSI tables <strong>in</strong> <strong>the</strong> annex to this report replace<br />

<strong>the</strong> tables published <strong>in</strong> previous reports.<br />

Serious accidents<br />

Report<strong>in</strong>g of serious accidents and accident<br />

<strong>in</strong>vestigations<br />

Independent accident <strong>in</strong>vestigation is a key element of learn<strong>in</strong>g<br />

lessons from accidents and <strong>in</strong>cidents. Even though all Member<br />

States except one have established an <strong>in</strong>dependent <strong>in</strong>vestigation<br />

body, <strong>the</strong> Agency still has concerns as to whe<strong>the</strong>r <strong>the</strong><br />

organisation and <strong>the</strong> procedures <strong>in</strong> some Member States comply<br />

with <strong>the</strong> requirements of <strong>the</strong> directive.<br />

The <strong>Railway</strong> <strong>Safety</strong> Directive requires <strong>the</strong> Member States to set<br />

up an <strong>in</strong>dependent accident <strong>in</strong>vestigation body that shall notify<br />

<strong>the</strong> Agency of any <strong>in</strong>vestigations opened as well as to sen d<br />

<strong>the</strong> full <strong>in</strong>vestigation report wh en <strong>the</strong> <strong>in</strong>vestigatio n is closed.<br />

In 2009, <strong>the</strong> national <strong>in</strong>vestigation bodies notified <strong>the</strong> Agency<br />

of 190 <strong>in</strong>vestigations opened and submitted 210 <strong>in</strong>vestigation<br />

reports. The <strong>in</strong>formation is publicly available <strong>in</strong> <strong>the</strong> Agency’s<br />

database <strong>ERA</strong>DIS.<br />

National <strong>in</strong>vestigation bodies<br />

Accord<strong>in</strong>g to Article 21 of <strong>the</strong> <strong>Railway</strong> <strong>Safety</strong> Directive,<br />

each Member State is required to set up a permanent<br />

<strong>in</strong>vestigation body with responsibility for <strong>in</strong>vestigat<strong>in</strong>g<br />

serious accidents and <strong>in</strong>cidents.<br />

The NIBs should <strong>in</strong>vestigate serious accidents, def<strong>in</strong>ed as<br />

an accident with at least one fatality, or five seriously<br />

<strong>in</strong>jured persons, or with an immediate estimated<br />

monetary cost of at least EUR 2 million.<br />

The <strong>in</strong>vestigation bodies should notify <strong>the</strong> Agency<br />

with<strong>in</strong> one week of <strong>the</strong> open<strong>in</strong>g of an <strong>in</strong>vestigation <strong>in</strong>to<br />

a serious accident and should send a full <strong>in</strong>vestigation<br />

report normally with<strong>in</strong> one year, after <strong>the</strong> occurrence of<br />

a serious accident.<br />

The accident report should ‘conta<strong>in</strong>, where appropriate,<br />

safety recommendations’. The recommendations should<br />

be addressed to <strong>the</strong> safety authorities, which must<br />

report back to <strong>the</strong> <strong>in</strong>vestigation body on actions taken.<br />
